AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA;AMENDING THE CITY CODE,CHAPTER 13,PUBLIC WORKS,ARTICLE 13-2,
SECTION 13-2-3,STREET IMPROVEMENTS,SUBSECTIONS A AND B;REPEALING ANY
CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA THAT:
SECTION I IN GENERAL
Amending the City Code,Public Works,Chapter 13,Article 13-2,Section 13-2-3,
Street Improvements,Subsection A,"Street Classification Plan"as follows:
A.The "Street Classification Plan"is hereby adopted and amended in a manner
and form annexed hereto and made a part of this article by reference,said
plan to be kept on file in the office of the city clerk.
Amending the City Code,Public Works,Chapter 13,Article 13-2,Section 13-2-3,
Street Improvements,Subsection B,should be amended to read as follows:
B.It shall be a condition precedent to the issuance of a building permit for
new construction within the city that the required street improvements be
made as set forth in the City of Apache Junction Development Guide.This
provision,however,shall not be applicable to the construction or
installation of individual,single family construction on individual lots
which are in existence at the time of passage of this subsection and
subsection C of this section or which are subsequently created without the
necessity of an applicant to comply with city and state subdivision
requirements.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance,or any part of the code adopted herein by reference,are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference,is for any
reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
