ORDINANCE NO.888 PAGE TWO OF FOUR TOGETHER WITH a strip of land 1.00 feet in width lying East of the East right-of-way line of Ness Boulevard,being more particularly described as follows: COMMENCING at the center of said Section 20;Thence North 000 04'15"Eat along the North -South mid -section line,a distance of 1011.72 feet;Thence South 89°55'45"East,a distance of 1339.96 feet to a point on the 'East right-of-way line of Lost Dutchman Boulevard (Plaza Drive);Thence'North 00°04'15"East along said right-of-way line,a distance of 843,e85 feet to a point;Thence 890 55'45"East,a distance of 975.10 feet to 'a point; Thence South 00° 05'15" West,a distance of 511.44 feet to THE/TRUE POINT OF BEGINNING;Thence continuing South 00°05'15"West,a/distance of 226.88 feet to a point on the Westerly right-of-way line of/Apache Trail; Thence South 38°02'21"West along said Westerly righ =of-way line,a distance of 1.63 feet;Thence departing said right-of-way line,North 00° 05'15"East,a distance of 228.16 feet to a point;Thence South 89°48' 29"East,a distance of 1.00 feet to the TRUE POINT OF BEGINNING; EXCEPT The North 400 feet, AND EXCEPT the South 30 feet of the North 430 feet of the West 375 feet; be and hereby is amended from GR (General Rural)to C-3/PD (General Commercial by Planned Development).The above rezonings are subject to the following stipulations: 1.Additional street improvements,including but not limited to, deceleration lanes,full paving,sidewalks,curbs,gutters,fire hydrants,retention basins and streetlights shall be provided by the property owner as may be needed along N.Plaza Drive and N.Apache Trail to handle the increase in' traffic and land use impact. 2.The commercial portion of the property,particularly the hotel, shall be constructed before' or concurrently with the Manufactured Home Park. 3.The Manufactured Home Park shall be constructed with a decorative” masonry perimeter wall/and buffering landscaping on all its sides to mitigate visual impacts and to protect the privacy and peace of the residents. 4.Vehicle and pedestrian access roads across the wash inside the park shall be incorporated into the site design. 5.The "Dutchman's Find"development shall not be constructed until sewer serviCe is available to the site or unless septic tanks or other solutions are recommended by ADEQ. 6.The 61 /feet indicated as Ness Boulevard be researched by property owner/to determine ownership. ORDINANCE NO 888 PAGE THREE tiF FOUR 7.Scenic Drive and the remainder of Ness Boulevard south of Scenic be applied for abandonment. 8.Preliminary and final Planned Development plans are to be,ipproved through the Planning Division, with final approval subject/to a City Council decision.i f 9.All other provisions of the Article 19 Planned DevelopMent Ordinance are to be satisfied. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by/reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,/clause or portion of this ordinance or any part of the code adopted herein/by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affec1t1 the validity of the remaining portion thereof.
