AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,RELATING TO THE CONDUCT OF BACKGROUND CHECKS BY
THE POLICE DEPARTMENT OF PURCHASERS OF HANDGUNS AS REQUIRED BY THE
FEDERAL BRADY HANDGUN VIOLENCE PREVENTION ACT;PRESCRIBING A FEE;
AMENDING CHAPTER 4 OF THE APACHE JUNCTION CITY CODE TO ADD NEW
ARTICLE 4-2;PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION,ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
The Apache Junction City Code,Chapter 4,Fees,is hereby amended to add new
Article 4-2 to read as follows:
Article 4-2 Fees Chargeable for Background Check Before Transfer of
Handguns
The Police Department shall charge a fee,in addition to any other fees
prescribed by law,in the amount of $10.00 to recover the costs of
criminal history background information checks the Police Department is
required to conduct before a handgun is transferred from a Federal
Firearms Licensee to an individual who is not a Federal Firearms Licensee.
The fee shall be charged for each such check performed.
SECTION I I PROVIDING FOR SEVERABILITY
If any provision of this ordinance,or the application thereof to any individual
or circumstances,is invalid,that invalidity shall not affect other provisions
or applications of this ordinance which can be given effect without the invalid
provisions or application,and to this end the provisions of this ordinance are
severable.
SECTION III EMERGENCY CLAUSE
WHEREAS,i t being necessary for the peace,health,and safety of the City of
Apache Junction,Arizona,an emergency is declared to exist,and this ordinance
shall be effective immediately upon its passage and adoption.
