AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AMENDING ARTICLE 2-11 HEALTH AND HUMAN SERVICES
COMMISSION,SECTION 2-11-2 MEMBERSHIP AND TERMS OF OFFICE,OF THE
APACHE JUNCTION CITY CODE; REPEALING ANY CONFLICTING PROVISIONS; AND
PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That Article 2-11 Health and Human Services,Section 2-11-2 Membership and Terms
of Office,Subsections (A),(B),and (C)be amended to read as follows:
A.The Health and Human Services Commission shall consist of five
members who shall be appointed by the Mayor and approved by the City
Council.
B.The appointments to this Commission shall be for terms of three
years each with the terms of members so staggered so that the terms
of office of no more than three members shall expire in any one
year.The initial appointments shall be for one member with term
beginning upon the appointment and expiring on June 30,1992;for
two members with terms beginning upon their appointment and expiring
on June 30,1993;and two members with terms beginning upon their
appointment and expiring on June 30,1994.Thereafter,upon
expiration of the term of office,all new appointments shall be
appointed for full three year terms,except that in the event of
death or resignation of a member,the vacancy shall be filled by
appointment of the Mayor,subject to the approval of the City
Council,for the unexpired term.
C.At least three of the five members shall be residents of the City of
Apache Junction,with no more than two being non-residents from
within the zone of influence.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,sub -section,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference is for any reason
held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
