FELIX 1785 -146 DATE:19NOV91 TIME:152-0 FEE:$3.50 $.00 $'..00 PAGES:006 DOCKET:1785 PAGE:146 - INSTRUMENT #026565 ORDINANCE NO.803 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE CITY OF APACHE JUNCTION,PINAL COUNTY,STATE OF ARIZONA,PURSUANT TO THE PROVISIONS OF TITLE 9, CHAPTER 4,ARTICLE 7,ARIZONA REVISED STATUTES AND AMENDMENTS THERETO,BY ANNEXING THERETO CERTAIN STATE AND FEDERAL TERRITORY CONTIGUOUS TO THE EXISTING CITY LIMITS OF THE CITY OF APACHE JUNCTION;REPEALING ANY CONFLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY. WHEREAS,a petition in writing,accompanied by a map or plot of said real property,having been filed and presented to the Mayor and Council of the City of Apache Junction,Arizona,signed by the owners of more than one-half in value of the real and personal property and more than one-half of the persons owning real and personal property as would be subject to taxation by the City of Apache Junction in the event of annexation within the territory and land hereinafter described as shown by the last assessment of said property,which said territory is contiguous to the City of Apache Junction and not now embraced within its limits,asking that the property more particularly hereinafter described be annexed to the City of Apache Junction,and to extend and increase the corporate limits of the City of Apache Junction so as to embrace the same;and WHEREAS,the Mayor and Council of the City of Apache Junction,Arizona,are desirous of complying with said petition and extending and increasing the corporate limits of the City of Apache Junction to include said territory;and WHEREAS,the said petition sets forth a true and correct description of all the exterior boundaries of the entire area proposed to be annexed to the City of Apache Junction,and had attached thereto at all times an accurate map of the territory desired to be annexed;and WHEREAS, no alterations increasing or reducing the territory sought to be annexed have been made after the said petition had been signed by any owner of real and personal property in such territory;and WHEREAS,the provisions of Section 9-471,Arizona Revised Statutes,and amendments thereto,have been fully observed;and WHEREAS,proper and sufficient certification and proof of the foregoing facts are now on file in the office of the City Clerk of the City of Apache Junction, Arizona,together with a true and correct copy of the original petition referred to herein,which is on file in the office of the county recorder. ORDINANCE NO.803 PAGE ONE OF FOUR 1785-14/ NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,THAT: SECTION I IN GENERAL The following legally -described territory be,and the same hereby is,annexed to the City of Apache Junction,and that the present corporate limits be,and the same hereby are,extended and increased to include the following described territory contiguous to the present City limits,to wit: Sections 7,8,9,and 10,EXCEPT the North fifty feet (50')thereof, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, Pinal County,Arizona;AND Section 11,EXCEPT the East fifty feet (50')and the North fifty feet (50')of the Northwest quarter of the Northwest quarter and EXCEPT the North fifty feet (50')of the Northeast quarter of the Northeast quarter and EXCEPT the East one-half of the Northwest quarter,and EXCEPT the West one-half of the Northeast quarter and EXCEPT the East thirty feet (30')of the West one-half of the Northwest quarter and EXCEPT the North forty feet (40')of the East one-half of the Southwest quarter and EXCEPT the North forty feet (40')of the West one-half of the Southeast quarter and EXCEPT the West thirty feet (30')of the East one-half of the Northeast quarter and EXCEPT the North forty feet (40')of the East thirty feet (30')of the Northwest quarter of the Southwest quarter and EXCEPT the North forty feet (40')of the West thirty feet (30')of the Northeast quarter of the Southeast quarter,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona;AND Section 14,EXCEPT the Southeast quarter and EXCEPT the South forty feet (40')and the East fifty feet (50')of the Northeast quarter and EXCEPT the East forty feet (40')of the Southwest quarter and EXCEPT the South forty feet (40')of the East forty feet (40')of the Northwest quarter, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, Pinal County,Arizona;AND The West one-half of Section 23,EXCEPT the East forty feet (40')thereof, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian, Pinal County,Arizona;AND Section 26,EXCEPT the East fifty feet (50'),and EXCEPT the North fifty feet (50')of the East one-half and EXCEPT the South fifty feet (50')of the West one-half and EXCEPT the North fifty feet (50')of the East forty feet (40')of the West one-half thereof,and EXCEPT the South fifty feet (50')of the West forty feet (40')of the East one-half thereof,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona;AND ORDINANCE NO.803 PAGE TWO OF FOUR 1785-148 The East one-half of Section 35,EXCEPT the West forty feet (40'),and EXCEPT the East fifty feet (50')of the Northeast quarter and EXCEPT the South fifty feet (50')of the East fifty feet (50')of the Southeast quarter,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona;AND The Southwest quarter of Section 36,EXCEPT the South fifty feet (50'), and EXCEPT the Northeast quarter and EXCEPT the North forty feet (40')and the East thirty feet (30')of the Northwest quarter and EXCEPT the North thirty feet (30')of the Southeast quarter and EXCEPT the North thirty feet (30')of the East thirty feet (30')of the Southwest quarter, Township I North,Range 8 East,Gila and Salt River Base and Meridian, Pinal County,Arizona;AND The South one-half of the Southeast quarter of Section 36,EXCEPT the North thirty feet (30'),the South fifty feet (50')and the East fifty feet (50'),Township I North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona;AND Section 2,EXCEPT the West,South and East fifty feet (50'),and EXCEPT the North fifty feet (50')of the West one-half and EXCEPT the North fifty feet (50')of the West forty feet (40')of the Northeast quarter,Township I South,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona. SECTION I I RECORDATION That a copy of this ordinance,together with an accurate map of the territory hereby annexed to the City of Apache Junction,Arizona certified by the Mayor of said City,be forthwith filed and recorded in the office of the County Recorder of Pinal County,Arizona. SECTION III REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portion thereof.
