AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,AMENDING VOLUME I I OF
THE APACHE JUNCTION CITY CODE,ENTITLED LAND
DEVELOPMENT CODE,CHAPTER 5,PERTAINING TO FLOODPLAIN
MANAGEMENT,PROVIDING FOR REPEAL OF CONFLICTING
PROVISIONS AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION,ARIZONA,THAT:
SECTION I IN GENERAL
That certain document entitled "Floodplain Management
Ordinance",adopted by Ordinance 569,as Chapter 5 of Volume
I I of the Land Development Code of the City of Apache
Junction i s hereby amended by adding,deleting or amending
as follows:
That Section 2.0 Definitions,"Floodplain administrator"be
amended as follows:
"Floodplain administrator"means the City Engineer of the
City of Apache Junction who i s hereby authorized by the
Floodplain Board to administer the provisions of this
ordinance.
That Section 2.0 Definitions,"Habitable floor"be deleted.
That Section 2.0 Definitions,"Manufactured home"be amended
for purposes of this Chapter as follows:
"Manufactured home"means a structure,transportable i n one
or more sections,which i s built on a permanent chassis and
i s designed for use with or without a permanent foundation
when attached to the required utilities.The term
"manufactured home"does not include a "recreational
vehicle".
That Section 2.0 Definitions,be amended by adding the
definition of "Recreational vehicle"for purposes of this
Chapter as follows:
"Recreational vehicle"means a vehicle which is:
(a)
(b)
built on a single chassis;
400 square feet or less when measured at the largest
horizontal projections;

(c)designed to be self-propelled or permanently towable
by a light duty truck;and
(d)designed primarily not for use as a permanent dwelling
but as temporary living quarters for recreational,
camping,travel,or seasonal use.
That Section 4.1,Establishment of Development Permit,
Subsection A.be amended as follows:
A.Proposed elevation in relation to mean sea level,of
the lowest floor (including basement)of all
structures;i n Zone A),elevation of existing grade
and proposed elevation of lowest floor of all
structures.
That Section 4.3 Technical Advisor be deleted.
That Section 5.6 Floodwavs,Subsection B.be amended as
follows:
B.All new construction and substantial improvements
shall comply with all other flood hazard reduction
provisions of Section 5.
SECTION I I REPEAL OF CONFLICTING ORDINANCES
All ordinances and parts of ordinances i n conflict with the
provisions of this ordinance or any part of the code adopted
herein by reference are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section sub -section,sentence,phrase,clause or
portion of this ordinance or any part of the code adopted
herein by reference i s for any reason held to be invalid or
unconstitutional by the decision of any court of competent
jurisdiction,such decision shall not affect the validity of
the remaining portion thereof.
