HomeMy WebLinkAboutORD827ORDINANCE NO.827 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA ZONING ORDINANCE,BY APPROVING A MAJOR AMENDMENT TO THE ROADHAVEN PLANNED DEVELOPMENT ZONING,REDUCING THE SETBACK REQUIREMENT TO THREE FEET FOR RECREATIONAL VEHICLES AND BUILDINGS; REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL Ordinance No.92 (Rezoning Case P7-6-81)and Ordinance No.163 (Rezoning Case PZ- 19-82)and Ordinance No.714 are hereby amended pursuant to Section 19.0111(2) of the Apache Junction Zoning Ordinance such that: Recreational vehicles and accessory structures/additions shall be setback not less than three feet (3')from all other property lines for the development of property known as the Roadhaven Recreational Vehicle Resort Subdivision,recorded with Pinal County in Cabinet A Slide 66-69 for Phase I and Cabinet A Slide 88-89 for Phase II,located on property at 1000 South Idaho Road which is also legally described as: The East 1/2 of the Northeast 1/4 of Section 29,Township 1 North,Range 8 East, Gila and Salt River Base and Meridian,Pinal County,Arizona; EXCEPT the South 1/2 of the Southeast 1/4 of the Northeast 1/4 and the Northeast 1/4 of the Northeast 1/4 of the Northeast 1/4 of said Section 29; AND the West 1/2 of the Northeast 1/4 of said Section 29; EXCEPT the North 1/2 of the Northwest 1/4 of the Northeast 1/4 of said Section 29;AND EXCEPT the West 1/2 of the West 1/2 of the Northwest 1/4 of the Northeast 1/4 of said Section 29;AND EXCEPT the West 1/2 of the West 1/2 of the Southwest 1/4 of the Northeast 1/4 of said Section 29;AND EXCEPT the South 355 feet of the East 1/2 of the West 1/2 of the Southwest 1/4 of the Northeast 1/4 of said Section 29. ORDINANCE NO.827 PAGE ONE OF TWO SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portion thereof.
