HomeMy WebLinkAboutORD829ORDINANCE NO.829 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-5-92 FROM GR (GENERAL RURAL)TO CR-1(MH)(SINGLE FAMILY RESIDENCES ON 20,000 SQ.FT. MINIMUM LOTS / MANUFACTURED HOMES PERMITTED);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcel of land described as: The South half of the East half of the North half of the Northwest quarter of the Northwest quarter of the Northeast quarter of Section 18,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona; be and hereby is amended from GR (General Rural)to CR-1(MH)(Single Family Residences on 20,000 sq.ft. Minimum Lots / Manufactured Homes Permitted);subject to the following stipulations: 1)The applicant will dedicate the East 33 feet and the South 25 feet of the subject site,along with a 20 -foot by 20 -foot cutoff at the Southeast inner right-of-way corner for public roadways,utilities and other associated purposes. 2)All nonconformities (structures and violations)on the property are to be removed and/or abated within 90 days of rezoning approval and subsequent replacement units are to be in complete compliance with current City codes and ordinances.If violations or nonconformities still exist after the 90 day period,the zoning shall automatically revert to its previous classification with no further legislative action. 3)The subsequent Land split shall not be approved until said nonconformities are completely resolved. 4)(Section 13.0111 Significance of Approval)Approval of rezoning constitutes authorization for the development of property under granted zoning.Rezoning approval is valid for a period of twenty-four (24) months from the date of the City Council decision.I f approval expires prior to substantial development upon the rezoned property,the zoning . ORDINANCE NO.829 PAGE ONE OF TWO shall revert to its former zoning classification without legislative action.If,no later than 150 days prior to the expiration of the zoning, the property owner files a request for a hearing to have the zoning extended for an additional period of time,the Planning and Zoning Commission and the City Council may consider granting the requested extension at their discretion. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section,sub -section,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portion thereof.
