HomeMy WebLinkAboutORD834ORDINANCE NO.834 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA;ESTABLISHING LOCATIONS FOR STOP SIGNS TOGETHER WITH REPEALING THE DESIGNATION OF CERTAIN LOCATIONS FOR STOP SIGNS IN THE CITY OF APACHE JUNCTION,ARIZONA;REPEALING ANY CONFLICTING PROVISIONS;PROVIDING FOR SEVERABILITY;PROVIDING FOR PENALTIES;AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA THAT: SECTION I IN GENERAL I t is in the public interest to insure safe,effective and efficient traffic flow along public rights -of -way within the City of Apache Junction,Arizona and i t has been determined that traffic control devices are necessary for the public safety.Now,therefore be i t ordained that stop signs be established at the following locations: Jacob Waltz Street -Westbound at Mountain View Road Lost Dutchman Boulevard -Westbound at Mountain View Road Lost Dutchman Boulevard -Eastbound at Mountain View Road Hackamore Road -Southbound at State Route 88 18th Avenue -Eastbound at Plaza Drive Furthermore,the Director of Public Works and the Director of Public Safety are hereby empowered and directed to initiate appropriate action to install, maintain and enforce said traffic control devices. SECTION I I IN GENERAL I t is in the public interest to insure safe,effective and efficient traffic flow throughout the City of Apache Junction,Arizona and whereas significant changes in traffic patterns have made it necessary to repeal the warrant for stop signs at the following locations: Greasewood Street -Westbound at Valley Drive Greasewood Street -Eastbound at San Marcos Drive Furthermore,the Director of Public Works is hereby empowered and directed to initiate appropriate action to remove said traffic control device. SECTION III REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinances,or any part of the code adopted herein by reference,are hereby repealed. Ordinance No.834 Page 1 of 2 SECTION IV PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof. SECTION V PENALTY CLAUSE Any person found guilty of any violation of or failure or refusal to do or perform any act required by Chapter 12 of this code constitutes a civil traffic violation.Civil traffic violations are subject to the provisions of Title 28, Chapter 6,Article 20 and 21,Arizona Revised Statute,and amendments thereof. SECTION VI EMERGENCY CLAUSE It is necessary for the preservation of the peace,health and safety of the City of Apache Junction,Arizona,that this ordinance become effective immediately,an emergency is hereby declared to exist and this ordinance shall be effective immediately upon passage and adoption.
