AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE CHAPTER 5,BY AMENDING SECTION
5-2-2,REPEALING ANY CONFLICTING PROVISIONS AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
Section 5-2-2 of the Apache Junction City Code shall be amended to read as
follows:
Sec.5-2-2 Magistrate Pro Tern
In the absence of the presiding city magistrate,or in those instances
where the presiding city magistrate has been disqualified by action of the
prosecution,defendant and/or recusation on the part of the presiding city
magistrate,then the presiding city magistrate of the magistrate court
shall secure the services of a duly elected or appointed State of Arizona
justice of the peace or city magistrate to act as a magistrate pro -tern to
provide such judicial services as are required by particular case or
cases.
SECTION I I REPEALING OF CONFLICTING ORDINANCES
All ordinances and parts of ordinances and/or provisions of the Apache Junction
City Code which are in conflict with the provisions of this ordinance are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,sub -section,sentence,phrase,clause or portion of this
ordinance or any part of the Code adopted herein by reference is for any reason
held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portion thereof.
