HomeMy WebLinkAboutORD841ORDINANCE NO. 841 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE PERSONNEL POLICIES,CITY OF APACHE JUNCTION, RULE III,CONDITIONS OF EMPLOYMENT,TO INCLUDE SECTION 5,DRUG -FREE WORKPLACE; REPEALING ANY CONFLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS: SECTION I.IN GENERAL That the Personnel Policies,City of Apache Junction, Arizona, Rule III Conditions of Employment,be amended to include: Section 5.Drug -Free Workplace:It is the policy of the City of Apache Junction to create a drug -free workplace in keeping with the spirit and intent of the Drug -Free Workplace Act of 1988.The use of controlled substances is inconsistent with the behavior expected of employees, subjects all employees and visitors to our facilities to unacceptable safety risks, and undermines the City's ability to operate effectively and efficiently.In this connection,the unlawful manufacture, distribution,dispensation,possession,sale,or use of a controlled substance in the workplace or while engaged in City business is strictly prohibited.Such conduct is also prohibited during nonworking hours to the extent that in the opinion of the City of Apache Junction,it impairs an employee's ability to perform on the job or threatens the reputation or integrity of the organization. To educate employees on the dangers of drug abuse, the City will implement a drug -free awareness program.Periodically, employees will be required to attend training sessions at which the dangers of drug abuse, the City's policy regarding drugs, the availability of counseling, and the City's employee assistance program will be discussed.Employees convicted of controlled substance -related violations in the workplace (including pleas of nob o contendere, i.e., no contest) must inform their Department Head within five days of such conviction of plea.Employees who violate any aspect of this policy may be subject to disciplinary action up to and including termination.At its discretion,the City may require employees who violate this policy to successfully complete a drug abuse assistance or rehabilitation program as a condition of continued employment. ORDINANCE NO. 841 PAGE ONE OF TWO SECTION II.REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III. PROVIDING FOR SEVERABILITY If any section, subsection, sentence, phrase, clause or portion of this ordinance or any part of the code adopted herein by reference is, for any reason, held to be invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
