AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION CITY CODE CHAPTER 3
ADMINISTRATION,ARTICLE 3-7 CONTRACT PROCEDURE,SECTION 3-7-5
PROFESSIONAL SERVICES (IN GENERAL),AND DELETING 3-7-7,CONTRACT
PROCEDURES FOR PROFESSIONAL ENGINEERING AND ARCHITECTURAL SERVICES;
REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR
SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AS FOLLOWS:
SECTION I IN GENERAL
That the Apache Junction City Code Chapter Administration,Article 3-7
Contract Procedure,Section 3-7-5 Professional Services (In General)be amended
to read as follows:
Section 3-7-5 Professional Services (In General)
A.Unless required by Council,provisions of this Article shall not
apply to professional services.Professional services permitted by this
section shall be limited to those projects approved by the City Council.
Such services shall include,but are not limited to:medical,legal,
architectural,surveying,financial,engineering and general management
services.
B.Requests for contracts for professional services shall be posted on
a public bulletin board at the official posting locations adopted by the
Council not less than forty-eight (48)hours before the time established
for submitting bids.
C.Whenever any contemplated purchase or contract for professional
services is for a sum in excess of $10,000.00,the purchasing officer
shall present the contract to the Council for approval and advise the
Council of the advantages or disadvantages of the proposed contract for
services.
D.This section shall not be used where Title 34 of the Arizona Revised
Statutes requires another method for selection of professional services.

That the Apache Junction City Code be amended by deleting Section 3-7-7,
Contract Procedures for Professional Engineering and Architectural Services in
its entirety.

SECTION I I REPEALING OF CONFLICTING ORDINANCES
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,subsection,sentence, phrase, clause or portion of this ordinance
or any part of the code adopted herein by reference is for any reason held to be
invalid or unconstitutional by the decision of any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portion thereof.
