HomeMy WebLinkAboutORD853ORDINANCE NO.853 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN CASE PZ-12-92 FROM CR-3 (SINGLE FAMILY RESIDENCES/CONVENTIONAL HOMES)TO CR-4/PD (RESIDENTIAL ZONE FOR A CHILD DAY CARE CENTER/PRE- SCHOOL BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,be and hereby is amended from CR-3 (Single Family Residences/Conventional Homes)to CR-4/PD (Residential Zone for a Child Day Care Center/Pre-School by Planned Development)for a 1.06 -acre parcel located approximately 660 feet south of the southwest corner of West 16th Avenue and South Ironwood Drive,and legally described as: The North half of the Northeast quarter of the Southeast quarter of the Northeast quarter of the Southeast quarter of Section 30, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona; EXCEPT the East 50 feet thereof for roadways and associated purposes per Docket 1152,Page 878,Pinal County Records. Subject to the following stipulations: 1.The property shall be developed within 24 months of rezoning approval or else the zoning may revert to its former classification per Section 19.0111.4 of the Planned Development ordinance. 2.Any use or development of said property shall be conditioned upon the provision of public improvements,a decorative masonry perimeter wall,and landscaping in accordance with the provisions of Article 19 of the Zoning Ordinance.The provisions of the Uniform Building Code and all other City Codes,policies,guides and standards shall apply and control all design and construction of improvements. 3.The preliminary and final plan approval,issuance of permits and development shall be conditioned upon site plan approval by the Development Coordinating Committee,as per the provisions of Article 19 of the Zoning Ordinance,including,but not limited to,the dedication of all rights -of -way and easements deemed necessary by the City prior to final plan approval. ORDINANCE NO.853 PAGE ONE OF TWO SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portion thereof.
