AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION CITY CODE ARTICLE 3-
7 CONTRACT PROCEDURE,SECTION 3-7-1 FORMAL CONTRACT PROCEDURE AND
SECTION 3-7-2 OPEN MARKET PROCEDURE:REPEALING ANY CONFLICTING
PROVISIONS:AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
That the Apache Junction City Code Article 3-7 Contract Procedure,Section 3-7-1
Formal Contract Procedure Subsection E and Section 3-7-2 Open Market Procedure
Subsection A,be amended to read as follows:
Section 3-7-1 Formal Contract Procedure.
E.Award of Contracts.Whenever any contemplated purchase,lease,rental,
contract for supplies,services,equipment or sale of personal property is
for a sum in excess of ten thousand dollars,such purchases,leases,
rentals,contracts or sales shall be presented to the City Council for
approval and the Council shall be advised of the advantages or
disadvantages of the proposed purchase,lease,rental,contract or sale.
All such purchases shall be awarded to the lowest bidder except as
otherwise provided herein.
Section 3-7-2 Open Market Procedure.
A.Purchases of supplies,equipment,contractual services,lease,rental and
sales of personal property of an estimated value in the amount of over
five hundred dollars,but not exceeding ten thousand dollars,may be made
by the purchasing officer in the open market by observing the procedure
prescribed in Section 3-7-1,with the following exceptions.
1.Minimum Number of Bids.Open market purchases shall,wherever
possible,be based on at least three bids,and shall be awarded to
the lowest responsible bidder.
2.Notice Inviting Bids.The purchasing officer shall solicit not less
than three written bids from prospective vendors.Notices will be
posted on a public bulletin board in the city not less than forty-
eight hours before opening bids.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.

SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference is for any reason
held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.
