HomeMy WebLinkAboutORD871ORDINANCE NO.871 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION, ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP.CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-4-93 FROM TH (TRAILER HOMESITES)TO CR-3(MH)/PD (SINGLE-FAMILY RESIDENCES WITH MANUFACTURED HOMES PERMITTED,BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Mao.City of Apache Junction.Arizona,for the parcels of land described as: Lots 40 through 126,inclusive,Enchanted Acres Unit Two,according to Book 16 of Maps,Page 58,records of Pinal County,Arizona; be and hereby is amended from TH (Trailer Homesites)to CR-3(MH)/PD (Single- Family Residences with Manufactured Homes permitted,by Planned Development), subject to the following stipulations: 1.No units more than 10 years old (at the time of Building Permit application)shall be allowed to be installed in the subdivision. 2.The applicant in this rezoning request shall construct a decorative 6 -foot masonry wall on the west and east sides of the subdivision to be located along the rear lots lines (inside alley lines),not to encroach into the alley easements.The wall is to be constructed within one year of rezoning approval,at which time a bond will be required i f the wall is not completed. 3.Front yards shall be designated as the street -fronting,narrow sides of each lot. 4.The following minimum setbacks shall be required for all corner lots, except Lot 108:Front yard -25 feet;Rear yard -15 feet;Street side yard -10 feet;Interior side yard -5 feet. 5.The following minimum setbacks shall be required for Lots 46,48,50,63, 65,67,80,82,84,97,99 and 101 (cul-de-sac lots):Front yard -20 feet;Rear yard -10 feet;Side yards -one side yard shall not be less than 5 feet and the total of both side yards shall not be less than 14 feet. ORDINANCE NO.871 PAGE ONE OF THREE 6.Lots 111 and 112,119 and 120,and 124 and 125 shall maintain 20 -foot wide unobstructed drainage easements between them,10 feet to the north and 10 feet to the south of their respective common boundary lines. 7 (Section 13.0111 Significance of Approval)Approval of rezoning constitutes authorization for the development of property under granted zoning.Rezoning approval is valid for a period of twenty-four (24) months from the date of the City Council decision.I f approval expires prior to *substantial development upon the rezoned property,the zoning shall revert to its former zoning classification without legislative action.If,no later than 150 days prior to the expiration of the zoning, the property owner files a request for a hearing to have the zoning extended for an additional period of time,the Planning and Zoning Commission and the City Council may consider granting the requested extension at their discretion.*(For this particular Planned Development, Enchanted Acres Unit Two,"substantial development"shall be defined as the development of at least 10 percent of the total lots.) 8.The rezoning shall be subject to the provisions of Section 19.0109 General Criteria,as required by the Planned Development ordinance. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portion thereof.
