AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF THE CITY
OF APACHE JUNCTION,ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA
ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF
APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT
CLASSIFICATION IN REZONING CASE PZ-4-96 FROM CI -1 (LIGHT INDUSTRY
AND WAREHOUSE ZONE)TO CR-3/PD (CONVENTIONAL SINGLE-FAMILY HOMES BY
PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND
PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map,City of Apache
Junction,Arizona,for the parcels of land described as:
That part of the Northeast quarter of the Southwest quarter of
Section 31,lying northeasterly of the northeast right-of-way line
of the Central Arizona Project canal;Township 1 North,Range 8 East
of the Gila and Salt River Base and Meridian,Apache Junction,Pinal
County,Arizona;AND
That part of the Southeast quarter of the Southwest quarter of
Section 31,lying northeasterly of the northeast right-of-way line
of the Central Arizona Project canal,EXCEPT for the west 190 feet
of the south 230 feet thereof;Township 1 North,Range 8 East of the
Gila and Salt River Base and Meridian,Apache Junction,Pinal
County,Arizona;
be and hereby is amended from CI -1 (Light Industry and Warehouse Zone)to CR-3/PD
(Conventional Single -Family Homes by Planned Development)in order to allow the
development of Ironwood Estates Subdivision,subject to the following
stipulations:
1)An emergency and/or secondary access road from W.Baseline Avenue,
the design and width of which is to be approved by the City Engineer
and the Fire District,shall be required at the time of subdivision
improvements.
2)The developers shall provide landscaping and amenity plans,to be
approved by the Parks and Recreation Department,for all of the
pedestrian linkage/open space areas,for the 36th Avenue and
Baseline Avenue accesses and for the retention area adjacent to the
Sewer District lift station.Said landscape tracts and open space
areas are to be developed in accordance with the Homeowners'
Association Maintained Open Space Standards.

3)No lot shall be smaller than 6050 net square feet in size;no less
than 55 feet in width;and all lots shall be subject to the
following minimum setbacks as measured from building to property
line:
a)Front =20 feet;
b)Rear =20 feet;
c)Side (interior lots)
=5 feet on one side,10 feet on the other;
d)Side (corner lot)
=5 feet on the interior side yard;15 feet
on the street side yard;street side yard setback
of a corner lot adjacent to a key lot shall be 20 feet.
e)A maximum of forty percent (40%)lot coverage shall be allowed.
4)Prior to construction and along with the improvement plans,the developers
must submit appropriate hydrological studies prepared by a qualified
engineer,determining what amount of development is appropriate due to
possible subsidence constraints,i f any.
5)The developers shall erect physical buffers such as landscaping and/or
screening walls,wherever possible,in order to mitigate both visual and
noise impacts.In particular,a 7 -foot wall shall be erected adjacent to
the Palmas Del Sol East Manufactured Home Park;and a wall shall be
erected,7 feet in height,along the site's north boundary.
6)Any use or development of said property shall be conditioned upon the
provision of public improvements,a decorative masonry perimeter wall,and
landscaping in accordance with the provisions of Article 19 of the Zoning
Ordinance and in accordance with the submitted proposal materials.The
provisions of the Uniform Building Code and all other City Codes,
policies,guides and standards shall apply and control all design and
construction of improvements.
7)The preliminary and final plan approval,issuance of permits and
development shall be conditioned upon site plan approval as per the
provisions of Article 19 of the Zoning Ordinance,within the appropriate
time frames,including but not limited to,the dedication of all rights-
of -way and easements deemed necessary by the City prior to final plan
approval.
8)One story homes are to be built adjacent to Palmas Del Sol East
Manufactured Home Park.
9)The developer shall construct a sidewalk within the existing right-of-way
on the south side of 36th Avenue,along the north frontages of the Casa
Blanca West Manufactured Home Park and the Arizona Water Company
properties,to the entrance of the Ironwood Estates subdivision,as
determined and specified by the City Engineer and City of Apache Junction
standards.

10)The developer shall install streetlights within the existing right-of-way
along the south side of 36th Avenue from Ironwood Drive to the entrance of
the Ironwood Estates subdivision as determined and specified by the City
Engineer and City of Apache Junction standards.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance,or any part of the code adopted herein by reference,are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference,is for any reason
held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.
