HomeMy WebLinkAboutORD987AORDINANCE NO.987 9P) k AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE NO.PZ-96-24 FROM CB-1(LOCAL BUSINESS)TO C-3/PD (GENERAL BUSINESS BY PLANNED DEVELOPMENT)FOR THE PURPOSE OF DEVELOPING A MINI -STORAGE FACILITY;REPEALING ANY CONFLICTING PROVISIONS; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcel of land described as: The South 290 feet of the East 570 feet of the Southwest quarter of the Southwest quarter of Section 31,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County, Arizona, be and hereby is amended from CB -1 (Local Business)to C-3/PD (General Commercial by Planned Development);subject to the following stipulations: 1.A final development plan will be developed in accordance with the stipulations of approval.. 2.Setbacks:Front 27' Side 10 adjacent to the open air parking spaces,0'for the remaining side areas Rear 0' 3.Buffer wall shall be allowed to me a maximum of 9'in height due to the fact that it will serve a dual purpose as a wall of the building(s)and a buffer device.Should the project be redesigned so that the buffer wall no longer serves as a wall for the building the maximum height will be 8'as required by Ordinance #940. ORDINANCEA0:987 - PAGE 1 OF 3 4.Percentage of open space will be a minimum of 10.24% as outlined in the landscaping requirements. 5.Parking requirements:5 spaces (9'x 20 standard size),plus 1 accessible space with the appropriate signage. 6.Minimum driving aisles within the project will be 28'wide main aisles and 20'auxiliary aisles. 7.Landscaping is to be provided as follows: -27'front setback -right-of-way -10'x 225'strip along the west property boundary adjacent to the pen air parking spaces -parking area -enlarged to include the additional required spaces -entrance feature as proposed -increase the size of the required plantings and density by 25% and,50%,respectively 8.Entry key switches for the gates will be required by the Apache Junction Fire District. 9.Two (2)fire hydrants capable of flowing 1500 GPM for a duration of 2 hours are required by the Apache Junction Fire District. 10.A final plan for the development must be submitted within one (1) year after the approval of the preliminary plan.The final plan must reflect all required stipulations of approval and be approved by the Planning and Zoning Commission and City Council. 11.Approval shall be valid for one (1)year from the date of the City Council action.The owner/developer may request an extension,not to exceed one (1)year,by formal written request and action by the Planning and Zoning Commission and City Council prior to the expiration date of the preliminary approval. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. ORDINANCE NO.987 PAGE 2 OF 3 / 4 SECTION III PROVIDING FOR SEVERABILITY If any section,subsection,sentence,phrase,clause or portion of this ordinance or any part of the Code adopted herein by reference is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
