AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION.ARIZONA.ZONING ORDINANCE,BY AMENDING
THE ZONING DISTRICT MAP.CITY OF APACHE JUNCTION.ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE NO.PZ-99-01 FROM GR (GENERAL RURAL,
SINGLE FAMILY RESIDENTIAL,1.25 ACRE MINIMUM PARCEL SIZE,CONVENTIONAL OR
MANUFACTURED HOUSING ALLOWED)AND CR-3 (SINGLE FAMILY RESIDENTIAL,7000 SQUARE
FOOT MINIMUM LOT SIZE,CONVENTIONAL CONSTRUCTION ONLY)TO CR-3/PD (SINGLE
FAMILY RESIDENTIAL,7000 SQUARE FOOT MINIMUM LOT SIZE,CONVENTIONAL
CONSTRUCTION ONLY BY PLANNED DEVELOPMENT)FOR THE PURPOSE OF DEVELOPING A 267
LOT RESIDENTIAL SUBDIVISION;REPEALING ANY CONFLICTING PROVISIONS;AND
PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map.City of Apache
Junction.Arizona,for the parcels of land described as:
Parcel No.1 (102-20-039A)
The Northwest quarter of the Northeast quarter of the North half
of the Southwest quarter of the Northeast quarter of Section 33,
Township 1 North,Range 8 East,Gila and Salt River Base and
Meridian,Pinal County,Arizona.
EXCEPT any portion lying Southerly of the following described line:
COMMENCING at the East quarter of said Section 33:
THENCE North 0 degrees 05 minutes 23 seconds West along the East
line of said Section 33,a distance of 150.00 feet;

THENCE South 89 degrees 56 minutes 10 seconds West 1321.94 feet:
THENCE North 0 degrees 03 minutes 50 seconds West 510.44 feet to
the POINT OF BEGINNING on the East line of said East half of the
Southwest quarter of the Northeast quarter of Section 33;
THENCE South 89 degrees 55 minutes 23 seconds West 1000.00 feet
to the POINT OF ENDING.

Tract C of PALM SPRINGS UNIT 15,according to the plat of records
in the Office of the County Recorder of Pinal County,Arizona,in
Book 15 of Maps,page 8.
be and hereby is amended from GR (General Rural,single family residential,
1.25 acre minimum parcel size,conventional or manufactured housing allowed)
and CR-3 (Single Family Residential,7000 square foot minimum lot size,
conventional construction only)to CR-3/PD (Single Family Residential,7000
square foot minimum lot size,conventional construction only by planned
development);subject to the following stipulations:
1.The subject property shall be developed within 24 months of
rezoning approval or the zoning may revert to its former
classification in accordance with Section 19.0111.4 of the Zoning
Ordinance.
2.All development and/or use requirements as indicated in Article
19 Planned Development section of the Zoning Ordinance will be
satisfied.The provisions of the Uniform Building Code and all
other City Codes,policies,guides and standards shall apply and
control all design and construction of improvements.
3.Minimum lot size will be 4950 square feet,minimum lot width will
be 45 feet.No more than 6.4% of the total number of lots will be
of the minimum size.

4.A minimum of 50% of the total number of lots will be a minimum of
50 feet in width.
5.Minimum Setbacks will be as follows:
Lot widths ranging from 45'-49.99'
Front 20'
Side 5'/5'
Street side 15'
Rear 20'
Lot widths 50'or greater
Front 20'
Side 5'/10'
Street side 15'
Rear 20'
6.The amount of open space provided will be increased by 5662.8 SQFT
in order to provide the required 10% open space for the 61.37 acre
parcel.
7.Tract C will be developed to function as a retention area and a
neighborhood park by providing a tot lot,picnic bench,and turf
area.
8.Elevation Certificates will be required for all lots affected by
the Zone A -100 year flood zone designation.Certificates of
Occupancy for any structures on the affected lots will not be
issued until the Elevation Certificates have been reviewed and
accepted by the City Engineer.
9.The Weekes Wash drainage channel easement,which affects the
subject property along the entire length of the eastern boundary,
will be fenced in the following manner:
•View fencing will be constructed along the eastern
edge of Tracts B,C,and E
•View fencing will be constructed in the front yard
area along the eastern property line of the lots
abutting the drainage easement,and the rear yards
will be fenced using a standard masonry wall.

10.Tracts 6,C and E shall be maintained by the Home Owners
Association.
11.Elevations and building footprint information will be provided for
review,in accordance with Article 19 requirements,prior to the
issuance of permits for construction.
12.Dedication of 50'of additional right-of-way along Southern Avenue
and 40'along Royal Palm Road are required by the City Engineer.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,subsection,sentence,phrase,clause or portion of this
ordinance or any part of the Code adopted herein by reference is for any
reason held to be invalid or unconstitutional by any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.
