AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION.ARIZONA ZONING ORDINANCE,BY AMENDING THE
ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-21-96 FROM GR (GENERAL RURAL)ZONE
TO CR-5/PD (CONVENTIONAL SINGLE AND/OR MULTI -FAMILY HOMES BY PLANNED DEVELOPMENT)
AND FROM GR (GENERAL RURAL)ZONE TO CR-3/PD (CONVENTIONAL SINGLE-FAMILY HOMES BY
PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR
SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map.City of Apache
Junction,Arizona,for the parcels of land described as:
The Northeast quarter of the Southwest quarter of Section 34,
Township 1 North,Range 8 East of the Gila and Salt River Base and
Meridian,Apache Junction,Pinal County,Arizona;
be and hereby is amended from GR (General Rural)Zone to CR-5/PD (Conventional
Single and/or Multi -Family Homes by Planned Development);AND THAT
The zoning district classification on the Zoning District Map.City of Apache
Junction,Arizona,for the parcels of land described as:
The Southeast quarter of the Southwest quarter of Section 34,
Township 1 North,Range 8 East of the Gila and Salt River Base and
Meridian,Apache Junction,Pinal County,Arizona;
be and hereby is amended from GR (General Rural)Zone to CR-3/PD (Conventional
Single -Family Homes by Planned Development),for the purpose of construction the
proposed Cortez Ranch subdivision,subject to the following stipulations:
1)The property owners shall dedicate any necessary right-of-ways,as
determined by the City Engineer,including,but not limited to,the east
40 feet for S.Cortez Road,the south 100 feet for E.Baseline Avenue,the
interior public streets of the eventual subdivision and any necessary cut-
off corners.
2)The subsequent subdivision plat shall conform substantially with the
preliminary plan or else a PD amendment may be required.

3)Future plans for the CR-5/PD-zoned,north 40 acres of the property,
reserved for single or multi -family housing,shall be subject to site plan
review and approval by the Commission and City Council through the public
hearing process.
4)Minimum lot sizes in the single-family area of the property shall be 4950
net square feet and larger for the 45 -foot -wide lots and 6050 net square
feet and larger for the 55 -foot -wide lots,with the following required
setbacks from property lines to main building:
a)Front =20 feet
b)Rear =20 feet
C)Side (interior lots)
=5 feet
d)Side (corner lot & corner lot adjacent to key lot)
=5 feet on the interior side yard;15 feet on the
street side yard.
5)Any use or development of said property shall be conditioned upon the
provision of public improvements,a decorative masonry perimeter wall,and
landscaping in accordance with the provisions of Article 19 of the Zoning
Ordinance.The provisions of the Uniform Building Code and all other City
Codes,policies,guides and standards shall apply and control all design
and construction of improvements.
6)The preliminary and final plan approval,issuance of permits and
development shall be conditioned upon site plan approval as per the
provisions of Article 19 of the Zoning Ordinance,including,but not
limited to,the dedication of all rights -of -way and easements deemed
necessary by the City prior to final plan approval.
7 )The property shall be developed within 24 months of rezoning approval or
else the zoning may revert to its former classification per Section
19.0111.4 of the Planned Development ordinance.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance,or any part of the code adopted herein by reference,are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference,is for any reason
held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.
