AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA AMENDING THE APACHE JUNCTION,ARIZONA.ZONING ORDINANCE,BY AMENDING
THE ZONING DISTRICT MAP.CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-05-97 FROM GR (CONVENTIONAL OR
MANUFACTURED SINGLE-FAMILY HOMES ON 1.25 -ACRE GROSS MINIMUM LOTS)TO CR-1 MH
(CONVENTIONAL OR MANUFACTURED SINGLE-FAMILY HOMES ON 20,000 SQ.FT.GROSS
MINIMUM LOTS);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR
SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map.City of Apache
Junction,Arizona,for the parcel of land described as:
The South half of the Northwest quarter of the Northeast quarter of the
Southwest quarter of the Southwest quarter of Section 18,Township 1
North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal
County,Arizona,less the West and South 33 feet for right-of-way
purposes:
be and hereby is amended from GR (conventional or manufactured single-family
homes on 1.25 -acre gross minimum lots)to CR-1 MH (conventional or
manufactured single-family homes on 20,000 square feet gross minimum lots),
subject to the following stipulations:
1.The dwelling placed on the remaining vacant lot,at such time the
above -mentioned property is split into a maximum of two (2)lots
and a building permit issued,must pay the appropriate impact fees
due at that time,including all other applicable fees.
2.Section 13.0111 Significance of Approval,Approval of rezoning
constitutes authorization for the development of the property
under granted zoning.Rezoning approval is valid for a period of
twenty-four (24)months from the date of the City Council
decision.If approval expires prior to substantial development
upon the rezoned property,the zoning shall revert to its former
zoning classification without legislative action.If,no later

than 150 days prior to the expiration of the zoning,the property
owner files a request for a hearing to have the zoning extended
for an additional period of time,the Planning and Zoning
Commission and the City Council may consider granting the
requested extension at their discretion.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference is for any
reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
