AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA;AMENDING THE APACHE JUNCTION CITY CODE CHAPTER 9
HEALTH AND SANITATION,ARTICLE 9-2 ACCUMULATIONS OF LITTER
PROHIBITED,SECTION 9-2-1(C)DEFINITIONS AND SECTION 9-2-5 OWNER TO
MAINTAIN PREMISES BY ESTABLISHING EXTENT OF RESPONSIBILITY FOR
PROPERTY OWNER MAINTENANCE;REPEALING ANY CONFLICTING PROVISIONS;
AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
That the Apache Junction City Code Chapter 9 Health and Sanitation,Article 9-2
Accumulations of Litter Prohibited,Section 9-2-1(C)Definitions and Section 9-2-
5 Owner to Maintain Premises,be amended to read as follows:
Section 9-2-1 Definitions
C."Private premises"means any parcel of land developed or
undeveloped,or any dwelling,house,building or other structure,
designed or used either wholly or in part for residential or
commercial purposes,whether inhabited or temporarily or
continuously uninhabited or vacant,and shall include any yard,
grounds,walk,driveway,porch,steps or vestibules belonging or
appurtenant to such dwelling,house,building or other structures.
Section 9-2-5 Owner to Maintain Premises
The owner or person in control of any private premises shall at all times
maintain the entire premises free of litter,refuse and rubbish,including
all abutting public ways from the back of the curb or edge of pavement
where curbs are not present and up to the center of abutting alleys;
provided,however,that this section shall not prohibit the storage of
litter,refuse or rubbish in authorized private receptacles for
collection.Repair of sidewalks within public right-of-way or easement
shall be the responsibility of the City.For purposes of this section,
either a tenant or a manager may be considered a "person in control"
depending upon the type of private premises involved in the violation.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.

SECTION III PROVIDING FOR SEVERABIL1TY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference is for any reason
held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portions thereof.
