HomeMy WebLinkAboutORD918ORDINANCE NO.918 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION, ARIZONA, ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE P7-94-08 FROM GR (GENERAL RURAL)TO CR- l(MH),SINGLE-FAMILY RESIDENTIAL (CONVENTIONAL OR MANUFACTURED HOMES PERMITTED ON 20,000 SQUARE -FOOT MINIMUM LOTS);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map.City of Apache Junction,Arizona,for the parcel of land described as: The West half of the Southwest quarter of the Southwest quarter of the Northwest quarter of the Southwest quarter of Section 17, Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Pinal County,Arizona; be and hereby is amended from GR (General Rural)to CR-1(MH),Single -Family Residential (Conventional or Manufactured Homes permitted on 20,000 square -foot minimum lots);subject to the following stipulations: 1.The property owner shall dedicate,for roadway and other associated purposes,the West fifty feet (50'),the South thirty-three feet (33'),and a twenty foot by twenty foot (20'x 20') cutoff at the Southeast inner rights -of -way corner; 2.The property owner shall comply with all Arizona State and City of Apache Junction Subdivision regulations;and 3.(Section 13.0111 Significance of Approval)Approval of rezoning constitutes authorization for the development of property under granted zoning.Rezoning approval is valid for a period of twenty-four (24)months from the date of the City Council decision.I f approval expires prior to substantial development upon the rezoned property,the zoning shall revert to its former zoning classification without legislative action.If,no later than 150 days prior to the expiration of the zoning,the property owner files a request for a hearing to have the zoning extended for an additional period of time, the Planning and Zoning Commission and the City Council may consider granting the requested extension at their discretion. ORDINANCE NO.918 PAGE ONE OF TWO SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
