AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA, AMENDING THE APACHE JUNCTION, ARIZONA,ZONING ORDINANCE,BY AMENDING THE
ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICATION IN REZONING CASE PZ-95-03 FROM GR (GENERAL RURAL)TO C-
3/PD (GENERAL COMMERCIAL BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING
PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map,City of
Apache Junction,Arizona,for the following legally -described parcel:
The South half of the Northwest quarter of the Southwest quarter of the
Northwest quarter of Section 33,Township 1 North,Range 8 East,Gila and
Salt River Base and Meridian,Pinal County,Arizona.
be and hereby is amended from GR (General Rural)to C-3/PD (General Commercial
by Planned Development)subject to the following stipulations:
1.Approval of rezoning constitutes authorization for the development
of property under granted zoning.Rezoning approval is valid for a
period of twenty-four (24)months from the date of the City Council
decision.If approval expires prior to substantial development upon
the rezoned property,the zoning shall revert to its former zoning
classification without legislative action.If,no later than 150
days prior to the expiration of the zoning,the property owner files
a request for a hearing to have the zoning extended for an
additional period of time,the Planning and Zoning Commission and
the City Council may consider granting the requested extension at
their discretion.
2.The final planned development plans for this project and any
divisions of this property shall substantially conform to the
approved preliminary planned development plan.
3.The north forty (40')feet of the property be dedicated for public
roadway purposes and the south ten (10')feet of the north fifty
(50')feet of the property be dedicated for utility purposes prior
to issuance of a building permit for this project.
4.The landscaping/irrigation plans be subject to the approval of the
Planning Division Manager.
5.At least three (3)additional parking spaces be provided near the
car wash facility.

6.A four -foot (4')wide landscaping strip be located at the north end
of the property between the sidewalk and the parking spaces.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance or any part of the code adopted herein by reference are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,sub -section,sentence,phrase,clause or portion of this
ordinance or any part of the code adopted herein by reference is for any reason
held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction,such decision shall not affect the validity of the remaining
portion thereof.
