HomeMy WebLinkAboutORD935ORDINANCE NO.935 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION, ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-95-04 FROM CR-3,SINGLE FAMILY RESIDENTIAL (CONVENTIONAL HOMES PERMITTED ON 20,000 SQUARE -FOOT MINIMUM LOTS IN FEDERALLY- PATENTED AREAS OR 7,000 SQUARE -FOOT MINIMUM LOTS IN A PLATTED SUBDIVISION)TO CR- 5/PD MULTIPLE FAMILY RESIDENTIAL,PLANNED DEVELOPMENT;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcel of land described as: The North half of the Southeast quarter of the Southeast quarter of Section 30,Township 1 North,Range 8 East,Gila and Salt River Base and Meridian,Apache Junction,Pinal County,Arizona; be and hereby is amended from CR-3,Single Family Residential,to CR-S/PD, Multiple Family Residential Planned Development;subject to the following stipulations: 1.The subject property shall be developed in substantial conformance with the development plans as approved. 2.The four (4)parcels which comprise the twenty (20)acres of the subject property shall be combined prior to the issuance of any building permits for this project. 3.A decorative barrier shall be constructed along the north,east and southern property boundary up to the point of the Apache Junction Health Center property. 4.Right-of-way for 20th Avenue to be provided along the westerly 330 feet of the subject property in a minimum width of 30 feet. 5.Section 13.0111 Significance of Approval Approval of rezoning constitutes authorization for the development of property under granted zoning.Rezoning approval is valid for a period of twenty- four (24)months from the date of the City Council decision.I f approval expires prior to substantial development upon the rezoned ORDINANCE NO.935 PAGE ONE OF TWO property,the zoning shall revert to its former zoning classification without legislative action.If,no later than 150 days prior to the expiration of the zoning,the property owner files a request for a hearing to have the zoning extended for an additional period of time,the Planning and Zoning Commission and the City Council may consider granting the requested extension at their discretion. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby appealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portion thereof.
