N ORDINANCE OF THE MAYOR AND CITY COUNCIL CIL OF THE CITY OF
AP ACHE E; JUNCTION, ARIZONA, AMENDING APACHE JUNCTION CITY
CODE, VOLUME I, CHAPTER FEES, TICI,R 4-5p - I L

PROVISIONS; AND PRC Id ING FOR SEVERABILITY.
WHEREAS, pursuant to Arizona Revised Statutes Titles 9 and
11, cities and towns are authorized to regulate various aspects of
animal control.; and
WHEREAS, the mayor and city council have over time amended
the animal control fee schedule (OrdinanceNo. 1311 - April 15,
2008, Ordinance No. 1416 - June 16, 2015 and Ordinance No. 1464'
February 4 018) ; and
WHEREAS, police staff recommends another fee schedule
increase based 'on comparisons with Other agencies and can April 2,
2024, presented such changes to the council; and
WHEREAS, pursuant to council direction to staff andA.R.S.
9-499, 15, staff provided a 60-day notice of intent to increase the
fee schedule and posted the increases on the city' s webers; and
WHEREAS, Can August 6, 2024, a publichearing was held on the
amendments.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS:

The Director of his/her designee may waive adoption Zees during
official adoption events to encourage adoptions to reduce high
inventories of animals
The Director or his/her designee may also request payment for
reasonable expenses relating to livestock adoptions.
Individuals that hold a class 3 personal drag kennel permit prior
to January 5, 2019, may continue owning, maintaining or harboring
9-12 drags, provided they are yap to date on permit fees and drag
licensing, and may continue to renew their permit until such time
they decide to surrender such permit or fail to pay the renewl
charge of $80.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All other ordinances and cants of ordinances in conflict with the
provisions of this ordinance or in conflict with any wart of the
code adapted herein by reference are also hereby repealed.
SECTION III PROVIDING FORILI 'y
If any section, subsection, sentence, phrase, clause or portion of
this ordinance, or any part of the code _ adopted herein by
reference is for any reason held to be invalid, pre-empted or
unconstitutional by the decision of any court of competent
jurisdiction, such decisions shall not affect the validity of the
remaining portions tarts thereof.
