HomeMy WebLinkAboutORD1538 ORDINANCE NO. 1538 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION CITY CODE, VOLUME I, CHAPTER 2 : MAYOR, COUNCIL, AND APPOINTED BOARDS AND COMMISSIONS, ARTICLE 2-8 : PARKS AND RECREATION COMMISSION, SECTIONS 2-8-3, 2-8-4, AND 2-8-8; REPEALING ANY CONFLICTING PROVISIONS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR PENALTIES. WHEREAS, staff completed an internal review of the above-noted code sections and found some minor irregularities such as outdated reference to a secretary on the parks and recreation commission and other. minor clerical discrepancies; and WHEREAS, on February 3, 2023, the mayor and city council authorized city staff and the parks and recreation commission to review the city code and consider staff suggested amendments to Article 2-8; and WHEREAS, the parks and recreation commission at their regularly scheduled April 5, 2023 meeting voted unanimously to recommend to council staff suggestions . NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS : SECTION I IN GENERAL A) That the following Apache Junction City Code Volume I provisions be amended to read as follows : § 2-8-3 SALARIES AND PERSONAL EXPENSES . The members of the Parks and Recreation Commission shall receive no salaries or other remuneration for their services in such capacity, and shall not be entitled to personal expenses incurred by them in the discharge of their official duties, except to the extent and purposes and amount such expenses are first authorized and approved in advance by the Council . ORDINANCE NO. 1538 PAGE 1 OF 3 § 2-8-4 OFFICERS . The Commission shall elect a Chairperson and a Vice Chairperson from their members to serve for a period of 1 year. The Vice Chairperson shall preside at meetings in the absence of the Chairperson. § 2-8-8 DUTIES . The Commission through the Director of Parks and Recreation shall recommend regulations and policies for the government, control and improvement of the public parks of the City of Apache Junction. The Commission shall also recommend fees for the use of public park facilities and recommend full-time or seasonal employees as necessary for the efficient management of the city parks and recreation program. SECTION II REPEALING ANY CONFLICTING PROVISIONS All other ordinances and parts of ordinances in conflict with the provisions of this ordinance or in conflict with any part of the code adopted herein by reference are also hereby repealed. SECTION III PROVIDING FOR SEVERABILITY If any section, subsection, sentence, phrase, clause or portion of this ordinance _or any part of the code adopted herein by reference is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. SECTION IV PROVIDING FOR PENALTIES Any violation of any of the provisions adopted herein shall be punishable as a class 1 misdemeanor consistent with Apache Junction City Code, Chapter 1, GENERAL, Article 1, Section 1-1-11, Penalty.
