AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF
APACHE JUNCTION, ARIZONA, REVISING THE APACHE JUNCTION
CITY CODE, VOLUME I, CHAPTER 3 : ADMINISTRATION, ARTICLE
3-13 : DEPARTMENT OF PARKS AND RECREATION, AMENDING
SECTION 3-13-3 POWERS AND DUTIES, AND REMOVING AND
REPEALING IN ITS ENTIRETY SECTION 3-13-5 BANNER PLACEMENT
AND SUPERVISION; REPEALING ANY CONFLICTING PROVISIONS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR PENALTIES .
WHEREAS, staff completed an internal review of the above-noted
code sections and found outdated references to supervising banner
placement, and found the need to clarify general tree management
and the use of approved landscaping standards for removal and
replacement of trees and plants; and
WHEREAS, on February 3, 2023, the mayor and city council
authorized city staff and the parks and recreation commission to
review the city code and consider staff suggested amendments to
Article 3-13; and
WHEREAS, the parks and recreation commission at their
regularly scheduled April 5, 2023 meeting voted unanimously to
recommend to council staff suggestions .
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF APACHE JUNCTION, ARIZONA, AS FOLLOWS :
SECTION I IN GENERAL
A) That the following Apache Junction City Code Volume I provisions
be amended as follows :
§ 3-13-3 POWERS AND DUTIES.
Repeal and remove subsection (G) .
Add to § 3-13-3 new subsections (G) and (H) :
(G) Assign the management and care of trees and plants in public
spaces to trained staff and volunteers within the department; and
maintain a process for removal and replacement as guided by the
department' s Parks, Open Space, and Right-Of-Way Landscape

Standards, which are regularly updated and visited to ensure best
practices .
(H) Create, update and follow routine inspection and maintenance
schedules for all city parks and recreation facilities, including
specialty amenities such as playgrounds, skate parks, and aquatic
centers .
§ 3-13-5 BANNER PLACEMENT AND SUPERVISION.
Repeal and removal of this section in its entirety.
SECTION II REPEALING ANY CONFLICTING PROVISIONS
All other ordinances and parts of ordinances in conflict with the
provisions of this ordinance or in conflict with any part of the
code adopted herein by reference are also hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
If any section, subsection, sentence, phrase, clause or portion of
this ordinance or any part of the code adopted herein by reference
is, for any reason, held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions thereof.
SECTION IV PROVIDING FOR PENALTIES
Any violation of any of the provisions adopted herein shall be
punishable as a class 1 misdemeanor consistent with Apache Junction
City Code, Chapter 1, GENERAL, Article 1, Section 1-1-11, Penalty.
