AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA ZONING ORDINANCE,BY AMENDING
THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING
DISTRICT CLASSIFICAITON IN REZONING CASE PZ-2-96 FROM CR-3 (CONVENTIONAL
SINGLE-FAMILY HOMES ON 7000 SQUARE FOOT MINIMUM LOTS)TO CR-3/PD (CONVENTIONAL
SINGLE-FAMILY HOMES BY PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING
PROVISIONS;AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
The zoning district classification on the Zoning District Map,City of Apache
Junction,Arizona,for the parcels of land described as:
Parcel No.1
The South half of the Northeast quarter of the Southeast quarter of
Section 30,Township 1 North,Range 8 East of the Gila and Salt River
Base and Meridian,Pinal County,Arizona;EXCEPT for the Northeast
quarter of the Southeast quarter of the Northeast quarter of the
Southeast quarter,thereof.
Parcel No.2
The West half of the Southeast quarter of Section 30,Township 1 North,
Range 8 East of the Gila and Salt River Base and Meridian,Pinal County,
Arizona;EXCEPT for the South 1017 feet thereof.
be and hereby is amended from CR-3 (Conventional Single -Family Homes on 7000
Square Foot Minimum Lots)to CR-3/PD (Conventional Single -Family Homes by
Planned Development)in order to allow the development of the Renaissance
Point Subdivision,subject to the following stipulations:
1)The minimum lot size in this subdivision shall be no smaller than 4725
square feet.
2)The minimum lot width shall be 45 feet.
3)Minimum setbacks shall be as follows:
Front Yard -20 feet
Rear Yard -20 feet
Side Yards -3 feet minimum on one side and 7 feet minimum
on the other,consistently throughout the
subdivision.

Street side yard setback of a corner lot shall be a minimum of 15 feet,
except that the street side yard setback of a corner lot adjacent to a
key lot shall be the minimum required front yard setback.The interior
side yard shall be a minimum of 3 feet.
4)A masonry,decorative,perimeter wall shall surround the subdivision,
except that where i t crosses the open space/drainage features,wrought
iron fencing with pedestrian accesses shall be permitted.
5)All open space tracts and right-of-ways as shown on the preliminary plan
shall be dedicated to the City,prior to final plat approval.
6)The applicants shall process any necessary street abandonments through
the City Engineer's office,particularly for sections of Palo Verde
Drive and 20th Avenue.
7)The property shall be developed within 24 months of rezoning approval or
else the zoning may revert to its former classification per Section
19.0111.4 of the Planned Development ordinance.
8)Any use or development of said property may be conditioned upon the
provision of public improvements,a decorative masonry perimeter wall,
and landscaping in accordance with the provisions of Article 19 of the
Zoning Ordinance.The provisions of the Uniform Building Code and all
other City Codes,policies,guides and standards shall apply and control
all design and construction of improvements.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of this
ordinance,or any part of the code adopted herein by reference,are hereby
repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference,is for any
reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
