HomeMy WebLinkAboutORD955ORDINANCE NO.955 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-96-08 FROM TH (TRAILER HOMESITE) TO TH/PD (TRAILER HOMESITE,PLANNED DEVELOPMENT)FOR APPROXIMATELY 82 ACRES AND C-3/PD (GENERAL COMMERCIAL,PLANNED DEVELOPMENT)FOR APPROXIMATELY 16 ACRES FOR THE DEVELOPMENT OF A MOBILE HOME SUBDIVISION WITH COMMERCIAL ZONING AT THE NORTHEAST CORNER OF MERIDIAN DRIVE AND SOUTHERN AVENUE;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcel of land described as: A portion of the Southwest quarter of Section 30, Township 1 North,Range 8 East,Gila and Salt River Base Meridian,Apache Junction,Pinal County,Arizona. be and hereby is amended from TH (Trailer Homesite)to TH/PD (Trailer Homesite,Planned Development)for approximately 82 acres and C-3/PD (General Commercial/Planned Development)for the remaining 16 acres to be developed as a mobile home subdivision with commercial zoning at the northeast corner of Meridian Drive and Southern Avenue,subject to the following stipulations: 1.A revised preliminary plat shall be prepared prior to the consideration of this item by the City Council.The revised preliminary plan shall address the comments/requirements noted in the review comments. 2.The meandering sidewalk,which is located along southern Delaware and wraps around the southeast corner of Southern Avenue,is to be relocated out of the bottom of the drainage channel in accordance to the City Engineer's comments. 3.Development of the General Commercial/Planned Development (C-3/PD) acreage shall follow the planned development process and be reviewed by the Planning and Zoning Commission and the City Council. ORDINANCE NO.955 PAGE 1 OF 2 SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance,or any part of the code adopted herein by reference,are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
