HomeMy WebLinkAboutORD960ORDINANCE NO.960 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AMENDING THE APACHE JUNCTION,ARIZONA ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-96-10 FROM CB -2 (GENERAL BUSINESS) FOR 3.99 ACRES AND CR-5 (MULTIPLE FAMILY RESIDENTIAL)FOR 0.767 ACRES TO C-3/PD (GENERAL COMMERCIAL/PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the parcel of land described as: A portion of the Northeast quarter of the Southeast quarter of Section 20,Township 1 North,Range 8 East,Gila and Salt River Base Meridian, Apache Junction,Pinal County,Arizona,lying South of the Right-of-way of the Mesa -Florence Junction Highway,which is also known as U.S. Highway 70-89,except the East 50 feet thereof. be and hereby is amended from CB -2 (General Business)for 3.99 acres and CR-5 (Multiple Family Residential)for 0.767 acres to C-3/PD (General Commercial/Planned Development)in order to allow the development of a pharmacy on approximately 2 acres of the subject parcel,with no specific use designated for the remainder of the parcel,subject to the following stipulations: 1.The entire 4.757 acres shall be rezoned C-3/PD (General Commercial/Planned Development). 2.The two (2)properties being rezoned shall be combined into one (1)parcel prior to the issuance of any permits. 3.One (1)common access point onto Idaho Road shall be established for both the pharmacy and the apartment complex use. 4.The final planned development plan for the pharmacy shall be reviewed by the Planning and Zoning Commission and City Council prior to issuance of any permits. 5.The remainder of the parcel not occupied by the pharmacy shall be subject to the planned development review process prior to issuance of any permits. Ordinance No.960 Page 1 of 2 SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance,or any part of the code adopted herein by reference,are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,subsection,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portions thereof.
