AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,ALLOWING A PLANNED DEVELOPMENT MAJOR AMENDMENT
FOR RENAISSANCE POINT SUBDIVISION BY AMENDING ORDINANCE NO.949;
REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR
SEVERABILITY.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,THAT:
SECTION I IN GENERAL
That stipulation number three (3)of Ordinance No.949 be rewritten and amended
to read as follows:
3)Minimum setbacks shall be as follows:
a)Front Yard -20 feet;
b)Rear Yard -20 feet;
c)Reduced rear yard setbacks,from 20 feet to 15 feet,shall be
permitted sparingly and only where needed to accommodate covered
patios on the smaller lots;
d)Side Yards -3 feet minimum on one side and 7 feet minimum on the
other consistently throughout the subdivision;
e)Street side yard setback of a corner lot shall be a minimum of 15
feet,except that the street side yard setback of a corner lot
adjacent to a key lot shall be the minimum required front yard
setback.The interior side yard shall be a minimum of 3 feet.
SECTION I I REPEALING ANY CONFLICTING PROVISIONS
All ordinances and parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
SECTION III PROVIDING FOR SEVERABILITY
I f any section,subsection,sentence,phrase,clause or portion of this
ordinance,or any part of the code adopted herein by reference,is for any
reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction,such decision shall not affect the validity of the
remaining portions thereof.
