HomeMy WebLinkAboutORD979ORDINANCE NO.979 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA, AMENDING THE APACHE JUNCTION, ARIZONA,ZONING ORDINANCE,BY AMENDING THE ZONING DISTRICT MAP,CITY OF APACHE JUNCTION,ARIZONA,CHANGING THE ZONING DISTRICT CLASSIFICATION IN REZONING CASE PZ-96-22 FROM C-3/PD (GENERAL COMMERCIAL/PLANNED DEVELOPMENT),C-2/PD (LOCAL COMMERCIAL/PLANNED DEVELOPMENT), CR-2/PD (SINGLE-FAMILY RESIDENTIAL/PLANNED DEVELOPMENT),and CR-5/PD (MULTIPLE- FAMILY RESIDENTIAL/PLANNED DEVELOPMENT)to CR-3/PD (SINGLE-FAMILY RESIDENTIAL/PLANNED DEVELOPMENT);REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL The zoning district classification on the Zoning District Map,City of Apache Junction,Arizona,for the following legally -described parcel: That part of the Southwest Quarter of Section 29,Township 1 North,Range 8 East of the Gila and Salt River Base and Meridian,Pinal County, Arizona,more particularly described as follows: Commencing at the Southwest Corner of said Section 29; Thence North 00000 00"East,along the West line of said Southwest Quarter,being the Monument line of Ironwood Drive,a distance of 964.08 feet to the True Point of Beginning; Thence continuing North 00000 00"East,along said West line,a distance of 1,677.11 feet to the West Quarter -Corner of said Section 29; Thence South 89°58'02"East,along the North line of said Southwest Quarter,being the Monument line of 16th Avenue,a distance of 2,640.67 feet to the Center of said Section 29; Thence South 00000 20"East,along the East line of said Southwest Quarter,being the Monument line of San Marcos Drive.a distance of 1,972.35 feet; Thence South 90000 00"West,a distance of 555.71 feet; Thence South 00000 00"East,a distance of 667.56 feet to the South line of said Southwest Quarter of said Section 29,also being the Monument line of Southern Avenue; Thence North 89°59'37"West,along said South line,a distance of 788.04 feet; Thence North Thence North Thence North Thence North Thence South of Beginning. ORDINANCE NO.979 PAGE ONE OF THREE 00°00 00" 89°59'37" 00°00'00" 45°53'57" 90°00'00" East, West, East, West, West, a distance a distance a distance a distance a distance of 350.00 feet; of 270.00 feet; of 458.45 feet; of 223.80 feet; of 866.39 feet to the True Point be and hereby is amended from C-3/PD (General Commercial/Planned Development), C-2/PD (Local Commercial/Planned Development),CR-2/PD (Single -Family Residential/Planned Development),and CR-5/PD (Multiple -Family Residential/Planned Development)to CR-3/PD (Single -Family Residential/Planned Development)subject to the following stipulations: 1.This zoning approval is valid for an indefinite period of time or until such time the parcels are subsequently reclassified by the City. 2.That the front setback be maintained at 20 feet,a rear setback of 15 feet be allowed,and that a street sideyard setback of 15 feet be allowed. 3.That the City's Street Naming map be amended to reflect the street names approved by the City Council for the final plat SD -96-06. 4.That the open space landscaping plans,improvements,and irrigation systems be approved by the Parks and Recreation Director,installed by the developer,and maintained by the homeowners association. 5.That a final subdivision plat (SD -96-06;Resolution No.97-02)be approved and recorded prior to issuance of any building permits unless an agreement or phasing schedule is approved by the City. 6.Development and subdivision of the property shall substantially conform to the approved preliminary and final planned development plan. SECTION I I REPEALING ANY CONFLICTING PROVISIONS All ordinances and parts of ordinances in conflict with the provisions of this ordinance or any part of the code adopted herein by reference are hereby repealed. SECTION III PROVIDING FOR SEVERABILITY I f any section,sub -section,sentence,phrase,clause or portion of this ordinance or any part of the code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,such decision shall not affect the validity of the remaining portion thereof.
