HomeMy WebLinkAboutORD980ORDINANCE NO.980 AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,ALLOWING A PLANNED DEVELOPMENT MAJOR AMENDMENT FOR THE PUEBLO BY AMENDING ORDINANCE NOS.199 AND 916;REPEALING ANY CONFLICTING PROVISIONS;AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF .APACHE JUNCTION, ARIZONA,THAT: SECTION I IN GENERAL That Ordinance Nos.199 and 916 be amended by adding/paragraphs 7 through 15 to Section I of said ordinances to read as follows: 7.The subdivision shall allow only the fgAowing dwelling types to be used as residences: a)Recreational vehicles (includ'g the Park Model st le)along with any legally permitted accessory str ctns; /A b)Conventional site-bugt hg04,built to Nform Building Code standards. 8.All residences shali l4zfub0Ct to the f o r i n g minimum setbacks as measured to property ltK,and as defin in the Pueblo's CC and Rs: ' , 1 Cle.nn+_7 ; A + . ro I I U116 /, )Sides -4/feet; \k '"// 6 feet (interior lots);C/ 10 feet (perimeter lots). 9.Conventio(ally constructed residences shall comply with the following design iteria: a)No structure may be taller than 13 feet 6 inches at the highest point; 4 /Roofs shall be shingled and peaked; Off-street driveway/parking space size shall be a minimum of 9 feet wide by 20 feet deep; Siding must be horizontal and of a neutral color. yoder or vinyl material,in a 10.No permanent structures,including air conditioning units and sheds,shall be constructed within any Public Utility Easements (PUEs),regardless of minimum setback requirements. ORDINANCE NO.980 PAGE 1 OF 3 11.The Architectural Review Committee and/or Homeowners Association,or their successors,shall be responsible for monitoring that proposed residences comply with the provisions of this ordinance. 12.The City shall not accept for processing,any building permit applications which have not been approved by the subdivision's Architectural Review Committee. 13.The subdivision's Homeowners Association shall have two years from the effective date of this ordinance,to initiate a subdi ision plat amendment.Said plat amendment shall address,at a minimum the issues of potential lot combinations,correct required setbacks,an relocatable and non-relocatable utility easements.If the plat amendme is not initiated within two years,lot combinations per the provisiori,of this ordinance shall not be allowed. 14.Subsequent to a successful subdivision plat am 'dment,an owner of two adjacent (side by side)lots may be allowed t 4 option of legally combining said lots into one,for the purpose f establishing one dwelling unit on the resultant lot.Any affected ut .ities within the PUEs between the lots shall be relocated accordingly, /f feasible to do,prior to new construction across previous lot s.In situations where the relocation of said utilities is not poWble of)feasible,lot combinations shall not be allowed. 15.The provisions of Article 19 of tly4 Zoning\Ofdinance,the Uniform Building Code and all other City Codes/guide lind standards shall apply and control all design and cons:76tion2f/iliprovementt)( SECTION I I REPEALING ANY CONFL TING PROV1VONS (1 /' All ordinances and parts of U(^dinan*in conflic b with the provisions of thic nrdinanrp Aro hrarrahv rPnAalPd \ SECTION III PROVIDING FOR'SEVERABILITY CJ I f any section,subsec on,sentence,phrase,clause or portion of this ordinance,or any part of the code adopted herein by reference,is for any reason held to be i , alid or unconstitutional by the decision of any court29ofcompetent juriscrction,such decision shall not affect the validity of the remaining portions/ thereof.
