A RESOLUTION OF THE CITY COUNCIL OF APACHE JUNCTION PLACING
A MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS FOR NEW
CONSTRUCTION WITHIN THE SERVICE AREA OF THE PALM SPRINGS
UTILITY COMPANY.
WHEREAS the City Council has received numerous
complaints about the quality of the domestic water delivered
within the Palm Springs Subdivision which is within the
service area of the Palm Springs Utility Company of Apache
Junction, including unplatable taste, low water pressure
causing unsanitary conditions, underground water line
breakage, main pump failures and inadequate pressure at
fire hydrants, and
WHEREAS a Survey of Water Problems was conducted
by the Palm Springs Homeowners Association and has been
submitted to the City Council by the Palm Springs Homeowners
Association containing data verifying the above, and the
Arizona Corporation Commission is investigating the service
and has set an order for a hearing and
WHEREAS said conditions within the service area are
a threat to the health, welfare and safety of the residents of the
Palm Springs Subdivision of Apache Junction;and
WHEREAS each and every additional water user added
to the apparently inadequate water system only serves to
compound existing threats,
NOW, THEREFORE, BE IT RESOLVED that a moratorium be
and the same is hereby ordered placed upon the issuance of
building permits for new construction of homes within the
service area of the Palm Springs Utility Company of Apache
Junction and the Zoning Administrator of the City be and she is
hereby instructed to so advise the public, and
FURTHER RESOLVED that until evidence of correction of the
conditions complained of be presented to the Zoning Administrator and
this Council sufficient to establish that the health, welfare and
safety of the residents of the service area of the Palm Springs Utility
Company of Arizona is no longer threatened by said conditions, this
moratorium will remain in effect.
