A RESOLUTION O F THE CITY COUNCIL OF APACHE JUNCTION
REQUESTING THE ARIZONA CORPORATION COMMISSION INVESTIGATE
THE ADEQUACY OF SERVICE PROVIDED BY THE PALM SPRINGS
UTILITY.
WHEREAS the Palm Springs Utility is a public service corpor-
ation as defined b y law and under the jurisdiction of and regulated
by the Arizona Corporation Commission pursuant to ARS 40-202.
AND WHEREAS the Palm Springs Utility holds a Certificate of
Convenience and Necessity to provide domestic water,service to
residents within the Palm Springs Water Company service area in
the City of Apache Junction,Arizona.
AND WHEREAS the Palm Springs Utility has inadequately pro-
vided such service to the residents within its service area and
specifically to residents in the Palm Springs subdivision of the City
of Apache Junction and in fact has been unable to supply domestic
water to the Palm Springs subdivision for at least three days.
AND WHEREAS the City Council deems a public emergency may
exist and it to be in the best interest of the citizens to request the
Arizona Corporation Commission to investigate the problems of in-
adequate service within the Palm Springs Utility area.
NOW THEREFORE BE IT RESOLVED that the City Council re-
quests the Arizona Corporation Commission to investigate the matter
of the adequacy of the service now being provided by Palm Springs
Utility within its service area and authorizes and directs the Mayor
to communicate said request to the Commission.
