A RESOLUTION OF THE CITY OF APACHE JUNCTION, FINAL COUNTY,
ARIZONA, REGARDING THE INCORPORATION OF AN INDUSTRIAL
DEVELOPMENT AUTHORITY FOR THE CITY OF APACHE JUNCTION, AND
DECLARING AN EMERGENCY
WHEREAS, a petition has been filed with the City Council of
the City of Apache Junction by three electors requesting permission to form
an Industrial Development Authority Board; and
WHEREAS, the Arizona Revised Statutes Section 9-1151 et seq and
section 10-451 et seq provide for the formation of Industrial Development
Plans for Municipalities and the formation of non-profit corporations,
respectively; and
BE IT RESOLVED, that this Council finds and determines that it is
wise, expedient, necessary, and advisable that an Industrial Development
Authority of the City of Apache Junction, Arizona, be incorporated in
accordance with and as provided in the application therefor, and
BE IT FURTHER RESOLVED that Dorothy Johnson, Ruby Forsberg and
Bill Wright be, and they are hereby, authorized to make application to form
a corporation pursuant to and as prescribed by the Arizona Revised Statutes,
and a copy of the proposed Articles of Incorporation, which are attached
hereto as Exhibit "A" and hereby is approved.
BE IT FURTHER RESOLVED THAT the name of said corporation shall be
"The Industrial Development Authority of the City of Apache Junction, Arizona,"
and IT IS FURTHER RESOLVED, that upon presentation to the City Council of the
City of Apache Junction, Arizona, of the Certificate of Incorporation of the
Industrial Development Authority of the City of Apache Junction, Arizona, the
City Council of the City of Apache Junction shall by Resolution elect the
first Board of Directors of said corporation.
The immediate operation of the provisions of this ordinance is
necessary for the preservation of the public peace, health and safety of
the City of Apache Junction, and an emergency is hereby declared to
exist, and this ordinance shall be in full force and effect from and after
its passage,adoption and approval by
Apache Junction, Arizona.
