A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA, AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO ENTER INTO
AGREEMENTS FOR PUBLIC IMPROVEMENTS AS A CONDITION PRECEDENT FOR THE
ISSUANCE OF A BUILDING PERMIT WHEREUNDER THE APPLICANT WOULD ENTER INTO
CERTAIN AGREEMENTS FOR PROVIDING PUBLIC IMPROVEMENTS UNDER CERTAIN
CONDITIONS: REPEALING CONFLICTING RESOLUTIONS; AND DECLARING AN
EMERGENCY.
WHEREAS, the City of Apache Junction, Arizona, from time to
time receives requests from individuals and/or developers for building
permits on individual lots to which the abutting public right-of-way
cannot be developed to minimum standards established by the City at
the time of said application; and
WHEREAS, a requirement to develop individual segments of a
public right-of-way would be impractical and more expensive to the
City for future maintenance; and
WHEREAS, the City of Apache Junction should provide such
reasonable agreements which would allow timely development of prop-
erty but at the same time insure that an individual and/or developer
assume the proper obligations for his proportional cost of providing
the public improvements;
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the
City of Apache Junction, Arizona does hereby authorize the Director
of Public Works to enter into agreements whereunder the applicant
would enter into certain agreements for providing public improvements
under certain conditions.
FURTHER RESOLVED that any Resolution, or part thereof, in conflict
with this resolution be and it is hereby repealed to the extent of
said conflict,: and
FURTHER RESOLVED that the immediate operation of this
Resolution is necessary for the preservation of the public
peace, health and safety of the City of Apache Junction, and
an emergency is declated to exist, and this Resolution shall
be in full force and effect from and after its passage,
adoption or approval by the City Council of Apache Junction.
