HomeMy WebLinkAboutRES79-52RESOLUTION NO.79-52 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF, APACHE JUNCTION DIRECTING THE CITY MANAGER TO PROCEED TO SECURE HEALTH SERVICES FOR THE CITY OF APACHE JUNCTION PURSUANT TO THE LAWS OF THE STATE OF ARIZONA.• WHEREAS, the residents of the City of Apache Junction pay Pinal County taxes for the support of the County Health Department and for services provided by.said Department; • WHEREAS, the citizens of Apache Junction pay State taxes for the support of the State Department of Health Services and for health services rendered by said Depart- ment; -WHEREAS, the Pinal County Health Department has refused to provide health services within the corporate limits of the City of Apache Junction and claims that said Department has no jurisdiction to -provide health services within the incorporated area of the City and that it has no obligation to provide health services within the incorporated area; .WHEREAS, Arizona Revised Statutes Title 36, Chapter 1, Article 4 requires County to continue to provide health services within the City limits of Apache Junction, notwith- standing its incorporation in November, 1978; and WHEREAS, the City has been advised by the Attorney • General's Office of the State of Arizona and by the State Department of Health Services that it will aid the City of Apache Junction in securing the standard of health care required by law within the City limits of Apache Junction, which standard of health care is required by law to be provided by Pinal County; WHEREAS, there is a serious risk to the health, welfare and safety of the residents of the City of Apache Junction unless and until the Pinal County. Health Department provides those health services within the. City of Apache Junction.. which are required by law to be provided. NOW, THEREFORE, BE IT RESOLVED that the City Manager be and he is hereby.directed.to"prOceed:to -take whatever actions are necessary to secure the proper ,standard of health care within the City of Apache Junction IrOM Pinal,:County.Health Department.•. FURTHER, RESOLVED THAT it is necessary- for the...preserva- tion of the peace,•health and safety of 'Apache junction, Arizona that an emergency be declared to exist and this . resolution Shall and the same is hereby ordered.to become immediately operative and in force from and after the date of this resolution. • PASSED AND APPROVED by three-quarters of the.
