HomeMy WebLinkAboutRES 80-17RESOLUTION NO.80-17 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION, ARIZONA,AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE THE PLANNING SERVICES CONTRACT BETWEEN THE CITY OF APACHE JUNCTION AND BUELL WINTER MOUSEL AND ASSOCIATES,INC.FOR THE PURPOSE OF PROVIDING AN AIRPORT MASTER PLAN AND SITE SELECTION STUDY FOR APACHE JUNCTION,ARIZONA. WHEREAS,this Council has received the written recommendation of the Apache Junction Airport Committee to approve the planning services contract employing Buell Winter Mousel & Associates,Inc.for the purpose of the preparation of an Airport Master Plan and Site Selection Study for Apache Junction,Arizona;and WHEREAS,the Study shall be prepared at a cost of $60,000 pursuant to the planning services contract;and WHEREAS,the maximum cost to the City shall not exceed $6,000, with the remaining $54,000 proposed to be funded by Arizona Department of Trans- portation Grant;and WHEREAS,i t is in the public interest to complete an Airport Master Plan and Site Selection Study for the City of Apache Junction: NOW, THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that the planning services contract employing Buell Winter Mouse]& Associates,Inc.and Coffman Associates, Inc.as consultants for the preparation of an Airport Master Plan and Site selection study for the City of Apache Junction be and is hereby approved, providing the maximum City cost shall not exceed $6,000;and BE IT FURHER RESOLVED,that the City Manager of the City of Apache Junction,Arizona be and is authorized,empowered and directed to execute said contract providing the City Manager has received to his satisfaction written confirmation of Arizona Department of Transportation funding of the balance of the cost of the contract. Goodwin MAY 1 6 1380 ARIZONA DEPARTMENT OF TRANSPORTATION AERONAUTICS DIVISION 205 South 17th Avenue Phoenix, Arizona 85007 PROJECT APPLICATION (For State Aid for Development of Public Airports) The City of Apache Junction Airport Apache Junction -New Date AFENo. PART I — PROJECT INFORMATION hereinafter called the "SPONSOR," hereby makes application to the State of Arizona. Department of Transportation, hereinafter called the "STATE," for a grant of State funds for the purpose of aiding in financing a project, hereinafter called the "PROJECT for the improvement of the Airport, hereinafter called the "AIRPORT," located at Apache Junction in the State of Arizona. It is proposed that the PROJECT will commence on or about Ju 1 y 1,1980 .and will consist of the following described airport improvements; all as shown on the approved Airport Layout Plan (ALP), and in the attached outline of construction methods which are made a part hereof. Total All Estimated Project Costs.$60,000 -0-$6,000 $54,000 PART II — REPRESENTATIONS The SPONSOR hereby represents and certifies as follows: 1.The SPONSOR has the legal power and authority: (1) to do all things necessary, in order to undertake and carry out the PROJECT;(2)to accept, receive and disburse grants of funds from the STATE in aid of the PROJECT; (3) to carry out all the provisions of PART III of this Project Application. R3/78 2.The SPONSOR now has on deposit, or is In a position to secure $6.000 or an equivalent amount represented by SPONSOR'S proposed labor and equIprrient costs, for use in defraying SPONSOR's share of the costs of the PROJECT. The present status of these funds Is as follows: 3.The SPONSOR possesses legal authority to apply for the grant and that a resolution, motion or similar action has been duly adopted or passed as an official act of the SPONSOR's governing body, authorizing the filing of the application, including all understandings and assurances contained therein, and directing and authorizing the person Identified as the official representative of the SPONSOR to act in connection with this application and to provide such additional information as may be required. The SPONSOR hereby designates NAME TITLE LO receive payments representing the STATEs share of PROJECT cost. PART III - SPONSOR'S ASSURANCES ADDRESS The SPONSOR hereby covenants and agrees with the STATE as follows: 1.That these covenants shall become effective upon execution of an Intergovernmental Agreement for the PROJECT or any portion thereof, made by the STATE and shall constitute a part of the Intergovernmental Agreement thus formed, and shall remain in full force and effect throughout the useful life of the facilities developed under the PROJECT, but in any event not to exceed twenty (20) years from date of said execution of the Intergovernmental Agreement 2.To operate the AIRPORT as such for the use and benefit of the public, and to keep the AIRPORT open to all types, kinds and classes of aeronautical use without discrimination between such types, kinds and classes; provided that the SPONSOR shall establish such fair, equal and nondiscriminatory conditions to be met by all users of the AIRPORT as may be necessary for the safe and efficient operation of the AIRPORT; and provide further, that the SPONSOR may prohibit any given type, kind or class of aeronautical use of the AIRPORT if such use would create unsafe conditions, interfere with normal operation of aircraft, or cause damages or lead to the deterioration of the runway or other AIRPORT facilities. S.To suitably operate and maintain the AIRPORT and all facilities thereon or connected therewith which are necessary for AIRPORT purposes, and to prohibit any activity thereon which would interfere with its use for aeronautical purposes. and to operate essential facilities, including night lighting systems, when installed, in such manner as to assure their availability to all users of the AIRPORT; provided that nothing contained therein shall be construed to require that the AIRPORT be operated and maintained for aeronautical uses during temporary periods when snow, flood or other climatic conditions interfere substantially with such operation and maintenance. 4.To refrain from entering into any transaction which would operate to deprive the SPONSOR of any of the rights and powers necessary to perform any or allot the covenants made herein, unless by such transaction the obligation to perform all such covenants is assumed by another public agency eligible to assume such obligations and having the power, authority and financial resources to carry out such obligations; and, if an arrangement is made for management or operation of the AIRPORT by an agency or person other than the SPONSOR or any employee of the SPONSOR, the SPONSOR will reserve sufficient powers and authority to insure that the AIRPORT will be operated and maintained in accordance with these covenants. 5.To maintain a current Airport Layout Plan (ALP) of the AIRPORT, having the approval of the STATE, which shows building areas and landing areas, indicating present and future proposed development; to conform to the ALP in making any future improvements or changes at the AIRPORT; and to furnish the STATE a current ALP of the AIRPORT and such information as is necessary to keep the ALP current. 6.The SPONSOR hereby assures that it is the Owner, or Lessee, of the property or properties on which the AIRPORT is located, and that the lease, if any, guarantees that the SPONSOR has full control of the use of the property for a period of not less than twenty (20) years from the date of the Agreement. 7.That it will give the STATE through any authorized representative access to and the right to examine all records, books, papers, or documents relating to the grant 8.The SPONSOR also assures that it will furnish to the STATE each month a current listing of all aircraft based on the AIRPORT. 9.The SPONSOR shall maintain accurate records of all labor, equipment and materials used in this PROJECT.
