HomeMy WebLinkAboutRES 80-09RESOLUTION NO.80-9 A RESOLUTION OF THE CITY OF APACHE JUNCTION, PINAL E.COUNTY, ARIZONA, REQUESTING THE FEDERAL EMERGENCY MANAGEMENT AGENCY, UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT TO EXPAND THE SCOPE OF STUDY IN PREPARATION OF ITS FLOOD INSURANCE RATE MAP AS IT RELATES TO THE CITY OF APACHE JUNCTION, ARIZONA. WHEREAS, the Federal Emergency Management Agency, United States Department of Housing and Urban Development, has notified the City of Apache Junction, Arizona, that the City contains areas of Special Hazard as depicted on a Preliminary Special Flood Hazard Map prepared for the said Federal Emergency Management Agency by its consultant, Michael Baker, Jr., Inc.; and WHEREAS, the City of Apache Junction did request by Resolution No.79_41 to be included in the National Flood Insurance Program as required by Public Laws 90-448, 91-152 and 92-234; and WHEREAS, the United States Department of Housing and Urban Development did accept the City of Apache Junction, Arizona into the National Flood Insurance Program effective December 20, 1979 and designated Apache Junction as Community No. 0401208; and WHEREAS, the Federal Emergency Management Agency has advised City officials that Apache Junction should use the above -described map as the best information for determin- ing special flood hazard areas; and WHEREAS, the Federal Emergency Management Agency has authorized a study to prepare a Flood Insurance Rate Map but which Flood Insurance Rate Map would cover only certain designated areas and which would not include the total area depicted on the Preliminary Special Flood Hazard Map; and WHEREAS, a F.lood Insurance Rate Map which does not cover the total area included in the City of Apache Junction would require the City to apply two different standards with respect to determining and regulating flood plain areas; and WHEREAS, the City is obligated to provide equal standards with respect to the determination and regulation of flood plain areas; and WHEREAS, without a Flood Insurance Rate Map covering the entire areas subject to flooding certain citizens would be subjected to different insurance rates and lesser insurance protection; NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION that the Federal Emergency Management Agency is urged to authorize the expansion of the scope of study for the Flood Insurance Rate Map; and BE IT FURTHER RESOLVED that the City of Apache Junction, Arizona urges the Secretary of the United States Department of Housing and Urban Development, Arizona Congres- sional Delegation, the Governor of the State of Arizona, and the Arizona Water Commission to support such extended study. BE IT FURTHER RESOLVED that the City Clerk be and she is hereby authorized and directed to send certified copies of this adopted Resolution to the above parties.
