HomeMy WebLinkAboutRES 80-36RESOLUTION NO.80-36 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE PINAL COUNTY RECORDER'S OFFICE FOR THE PURPOSE OF USING THE COUNTY REGISTRATION ROLLS TO CONDUCT THE CITY'S ELECTIONS. WHEREAS,the City of Apache Junction,a municipal corporation i s authorized to enter into a contract with the Pinal County Recorder by the use of the County Registration Rolls to conduct City Elections: WHEREAS,the City desires to use the County Registration Rolls for all future elections held by the City,and the County has agreed to said use of County Registration Rolls; NOW,THEREFORE,BE IT RESOLVED,that the Mayor of the City of Apache Junction be,and hereby is,authorized and directed to enter into an agreement dated November ,1980 with the Pinal County Recorder for the use of the County Registration Rolls i n future City Elections; FURTHER,that the City Clerk be,and hereby is,authorized and directed to reimburse the County Recorder for his actual expenses i n preparing the necessary lists for use i n the election; FURTHER,that the City Clerk be,and hereby is,authorized and directed to do all necessary acts to secure the necessary lists from the County Recorder,pursuant to said agreement. ATTEST: RICH OESTERLE City Clerk APPROVED AS TO FORM: vIRGIN/A SEEMAN Mayor city Attorney AGREEMENT THIS AGREEMENT made and entered into by and between the City of Apache Junction,a Municipal corporation,hereinafter designated as City, and William S.Truman,Pinal County Recorder,hereinafter referred to as Recorder. WITNESSETH: WHEREAS,ARS Section 16-172 authorizes any political subdivision conducting an election pursuant to the laws of the State to use the County Registration Rolls in the conduct thereof,and to reimburse the County Recorder for actual expenses in preparing the necessary lists for use in such election;and, WHEREAS,the City of Apache Junction desires to use such Pinal County Registration Rolls for all future elections; NOW,THEREFORE,IT IS AGREED AS FOLLOWS: 1.The City Clerk of the City of Apache Junction,shall apprise the Recorder of the City limits boundaries as of the date of execution of this agreement,and further shall notify the Recorder of any subsequent changes thereto. 2.The City Clerk shall notify the Recorder of any scheduled election for which lists are required,such notification to be given in writing and not less than fifty (50)days prior thereto. 3.The Recorder shall furnish copies of Precinct Registers,such copies to be prepared and certified in accordance with the relevant portions of ARS 16-168 and ARS 16-169. 4.Said Precinct Registers shall encompass all voting precincts, or portions of voting precincts, within the City such that every registered voter resident therein is listed. 5.Said lists shall be prepared as of the close of registration for each election,which shall occur as of 5:00 p.m.on the fiftieth day preceding such election,and shall be delivered to the City not later than the fifth day preceding said election. 6.The Recorder shall furnish suitable covers for said lists, and other election supplies as needed,if available.Such other election supplies shall include preliminary,uncertified lists of eligible voters to be used to facilitate absentee voting,and for such other purposes as the City deems necessary or advisable. Said uncertified lists shall be furnished by the Recorder as soon as practicable,normally no later than thirty-three (33)days prior to each election,in order to be available for absentee voting. 7.City shall reimburse Recorder for actual costs incurred i n carrying out this agreement.Claims for such payment shall be submitted and approved i n the same manner as are other expenditures by the City. 8.This agreement shall be,prior to its execution,submitted to the Pinal County Attorney and the City Attorney for the City of Apache Junction,who shall determine that this agreement i s i n the proper form and within the powers and authority granted under the laws o f this State,to the City of Apache Junction and to Pinal County through its County Recorder and said attorneys shall endorse their approval hereon. 9.This Agreement shall be effective when approved by the Pinal County Board o f Supervisors on behalf of Pinal County and the Common Council o f the City of Apache Junction on behalf of the City of Apache Junction and upon its being filed with the Pinal County Recorder's office as provided i n ARS Section 11-952.This Agreement shall continue i n full force and effect until the 31st day of December,1981,except that either party may cancel upon 30 days written notice given to the other.
