A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF APACHE
JUNCTION, ARIZONA RELATING TO FEDERAL PATENT LANDS WITHIN
THE CITY OF APACHE JUNCTION; REPEALING CONFLICTING
RESOLUTION; AND DECLARING AN EMERGENCY.
WHEREAS, from time to time certain lands in Pinal
County which were formerly federal lands have been patented
to private citizens; and
WHEREAS, with federal patents were issued to the
citizens subject to certain easements and rights -of -way for
roads and public utilities; and
WHEREAS, said easements and rights -of -way were for
the benefit of the public and for public use and are
exerciseable by local governmental agencies; and
WHEREAS, many of these patented lands lie in
incorporated areas of the City of Apache Junction; and
WHEREAS, the City of Apache Junction has
jurisdiction over public roads within an incorporated area
within the City of Apache Junction, such jurisdiction being
properly exercised by the City Council of Apache Junction;
and
WHEREAS, by Resolution No. 103078, the Pinal
County Board of Supervisors did, on October 30, 1978 accept
the dedication of all easements and rights -of -ways dedicated
to the public use which were found on private land in Pinal
County, the title of which derives from federal patents; and
WHEREAS, the City of Apache Junction incorporated
on November 24, 1978 and became the legal governing body of
the lands which were formerly federal lands and to which the
federal patents were issued;
NOW THEREFORE BE IT RESOLVED, that the City
Council of the City of Apache Junction does confirm the
acceptance of the dedication of all easements and
rights -of -ways dedicated to the public use and on private
lands in incorporated areas of the City of Apache Junction,
the title of which derives from federal patents.
FURTHER RESOLVED that any Resolution or part
thereof in conflict with this resolution be and it is hereby
repealed to the extent of said conflict; and
FURTHER RESOLVED that the immediate operation of
this Resolution is necessary for the preservation of the
public peace, health and safety of the City of Apache
Junction and an emergency is declared to exist, and this
Resolution shall be in full force and effect from and after
its passage, adoption or approval by the City Council of
Apache Junction.
