A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY
OF APACHE JUNCTION,ARIZONA,REQUESTING THE ARIZONA
CORPORATION COMMISSION TO REVIEW THE RECENT RATE INCREASE
GRANTED TO PALM SPRINGS WATER COMPANY,A SUBSIDIARY OF
CONSOLIDATED WATER UTILITIES,AND TO CONSIDER TAKING
APPROPRIATE ACTION.
WHEREAS,a substantial portion of the Palm Springs Water Company
certificated area lies within the city of Apache Junction,Arizona;and
WHEREAS,citizens of this city residing i n the Palm Springs Water
Company certificated area must rely on said company for delivery of domes-
tic water as a basic need;and
WHEREAS,i t i s commonly understood that this service i s provided
for the public health,safety,and welfare but that,as a private water
company,Palm Springs Water Company i s entitled to a reasonable profit;
and
WHEREAS,numerous citizens of Apache Junction have approached and
petitioned the City Council with regard to the new Palm Springs Water rates,
such rates which these many citizens contend are beyond their economic means
and are excessive for the service provided,all matters considered;and
WHEREAS,several hundred of these citizens did attend and,through
spokesmen,made comment at the Commission's public hearing on the proposed
rate increase,such comment which seems to have been made but not with
effect;and
WHEREAS,the numerous citizens are requesting the City Council
to petition the Arizona Corporation Commission,whose duty i t i s to
establish fair utility rates,and to request a new public hearing and
review of the recent decision;
NOW THEREFORE,BE IT RESOLVED by the Mayor and City Council of
the City of Apache Junction,Arizona,that this Council does hereby re-
quest the Arizona Corporation Commission to review its most recent decision
with regard to Palm Springs Water Company;and
BE IT FURTHER RESOLVED that i t i s hereby requested that the
Commission hold a public meeting i n Apache Junction to explain the most
recent decision and,i f permitted by law,to take further public comment
and any appropriate action deemed necessary.
BE IT FURTHER RESOLVED that the City Clerk be and hereby i s
authorized and directed to send certified copies of the Resolution to
the Governor of the State,Arizona State Legislative Delegation from
this area,the Attorney General,the Pinal County Board of Supervisors,
and other appropriate officials.
