A RESOLUTION OF THE MAYOR AND CITY COUNCIL
OF THE CITY OF APACHE JUNCTION,ARIZONA,
GIVING AUTHORITY TO THE COUNTY ATTORNEY'S
OFFICE OF PINAL COUNTY TO PROSECUTE MIS-
DEMEANOR CASES IN THE APACHE JUNCTION
MAGISTRATE COURT.
WHEREAS,there i s concurrent jurisdiction between the
Justice of the Peace Court and the City Magistrate Court;and
WHEREAS,there are times where conflict of interest makes
i t improper for the City Attorney to prosecute misdemeanor cases;and
WHEREAS,the County Attorney's office would be the proper
prosecutorial agency i n cases of conflict;
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council
of the City of Apache Junction,Arizona,that authority be given to the
County Attorney's office to prosecute cases i n the Apache Junction City
Magistrate Court where conflicts arise.
PASSED AND ADOPTED by the Mayor and City Council of the City
of Apache Junction,Arizona this 4th day of November ,1981.
