A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE
JUNCTION,ARIZONA,DECLARING THAT PORTION OF SOUTH SOLANO ROAD
DESCRIBED HEREIN,A FEDERALLY PATENTED EASEMENT,IS HEREBY ABAN-
DONED AS A PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY,BUT RESERVING
UTILITY EASEMENTS.
WHEREAS,certain residents of South Solano Road have made application
for the abandonment of South Solano Road described as follows:
Parcel No.1
the West 33 feet of the Southeast 1/4 of the Southeast 1/4.of the South-
west 4 of the Southeast 4 of Section 22,Township 1 North,Range 8
East,Gila and Salt River Base and Meridian,located i n Apache
Junct*on,Pinal County,Arizona;EXCEPT the North 33 feet,and EXCEPT
the South 50 feet;
Parcel No.2
the East 33 feet of the Southwest 1/4 of the Southeast 1/4 of the South-
west 4 of the Southeast 4 of Section 22,Township 1 North,Range 8
East,Gila and Salt River Base and Meridian,located i n Apache
Junction,Pinal County,Arizona;EXCEPT the North 33 feet, -and EXCEPT
the South 50 feet;and
WHEREAS,the Planning and Zoning Commission has held a public hearing
on November 10,1981,and has recommended to the City Council the abandon-
ment of said right-of-way contingent upon:
1)Salt River Project removing a power pole guide wire,or move the
power pole and wire,at no cost to the city,whereby the facility
would no longer be located within Seventh Avenue;and
2)Seventh Avenue be graded between Starr Road and at least the subject
area so that properties i n the subject area would have access from
Seventh Avenue;and
3)Should,during the grading process,water lines be broken,repairs
would be at city expense;and
4)That portion on the southern end of Solano Road that would be needed
for an expanded Broadway Road not be abandoned;and
WHEREAS,Solano Road i s a local street on the Street Classification Plan
and i s not needed to serve a greater area;and
WHEREAS,each of the lots i n the subject area would have access should
Solano Road i n the subject area be abandoned;and
WHEREAS,certain utility companies have requested utility easements be
retained;
NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City
of Apache Junction,Arizona,that that portion of South Solano Road described
above is hereby abandoned as a federally patented easement reserved for public
right-of-way,but reserving utility easements within said described area;
BE IT FURTHER RESOLVED that the recommendations of the Planning and Zoning
Commission are hereby incorporated and are made precedent to final approval of
the said abandonment.
PASSED AND ADOPTED by the Mayor and City Council of the City of
Apache Junction,Arizona,this 2nd day of December ,1981 •
