A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,
ARIZONA,DECLARING THAT PORTION OF NORTH GOLD DRIVE AND WEST SMOKETREE
STREET DESCRIBED HEREIN,FEDERALLY PATENTED EASEMENTS,ARE HEREBY ABANDONED
AS A PRESENT OR FUTURE PUBLIC RIGHT-OF-WAY,BUT RESERVING UTILITY EASEMENTS.
WHEREAS,certain property owners on North Gold Drive and West Smoketree street
have made application for the abandonment of portions of said public rights-
of -way contiguous to their property described as follows:
Parcel No.1
The North 33 feet of the Southwest 4 of the Southwest 4 of the Northwest
4 of Section 17,Township 1 North,Range 8 East,Gila &Salt River Base &
Meridian,located i n Apache Junction,Pinal County,Arizona;EXCEPT the
West 50 feet.
Parcel No.2
The East 33 feet of the Southwest 1/4 of the Southwest 4 of the Northwest
1/4 of Section 17,Township 1 North,Range 8 East,Gila &Salt River Base &
Meridian,located i n Apache Junction,Pinal County,Arizona;EXCEPT the
South 40 feet.
Parcel No.3
The South 33 feet of the Northwest 1/4 of the Southwest 4 of the Northwest
,Section 17,Township 1 North,Range 8 East,Gila &Salt River Base &
Meridian,located i n Apache Junction,Pinal County,Arizona;EXCEPT the
West 50 feet.
Parcel No.4
The East 33 feet of the Northwest 4 of the Southwest 4 of the Northwest
1/4,Section 17,Township 1 North,Range 8 East,Gila &Salt River Base &
Meridian,located i n Apache Junction,Pinal County,Arizona;EXCEPT the
North 33 feet.

The West 33 feet of the Northeast 4 of the Southwest 4 of the Northwest
4,Section 17,Township 1 North,Range'8 East,Gila &Salt River Base &

The North 33 feet of the Southeast 4 of the Southwest 4 of the Northwest

Meridian,located i n Apache Junction,Pinal County,Arizona;EXCEPT the
East 33 feet.

The West 33 feet of the Southeast ¼of the Southwest 4 of the
Northwest 14 ,Section 17,Township 1 North,Range 8 East,Gila &
Salt River Base &Meridian,located i n Apache Junction,Pinal County,
Arizona;EXCEPT the South 40 feet.
WHEREAS,the Planning &Zoning Commission has held a public hearing
on November 10,1981 and has recommended to the City Council the abandonment
of said right-of-way;and
WHEREAS,North Gold Drive and West Smoketree Street are classified
as local streets on the Apache Junction Street Classification Plan;and
WHEREAS,the Planning &Zoning Commission has determined these streets
are not needed to serve a greater area;and
WHEREAS,each of the parcels i n individual ownership would have access
should both of the said portions of public right-of-way be abandoned;and
WHEREAS,certain utility companies have requested utility easements be
retained;
NOW,THEREFORE,BE IT RESOLVED by the Mayor &City Council of the City
of Apache Junction,Arizona,that those portions of North Gold Drive and
West Smoketree Street described above i s hereby abandoned as a federally
patented easement reserved for public right-of-way,but reserving utility
easements within said described area.
PASSED AND ADOPTED by the Mayor and City Council of the City of
Apache Junction,Arizona,this 5th day of January ,1982.
