A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE
CITY OF APACHE JUNCTION, ARIZONA SETTING FORTH ITS
INTENT TO CONTRACT FOR THE DELIVERY OF MUNICIPAL
AND INDUSTRIAL WATER OF THE CENTRAL ARIZONA
PROJECT, IN THE EVENT THE PRIVATE WATER COMPANIES
NOW SERVING THE CITY FAIL TO ENTER INTO CONTRACTS
FOR PURCHASE OF CENTRAL ARIZONA PROJECT WATER.
WHEREAS, the City of Apache Junction receives 100%
of its municipal and industrial water from the Arizona Water
Company and Consolidated Water Company, both privately owned
water companies; and
WHEREAS, neither the Arizona Water Company nor
Consolidated Water Company have entered into unconditional
contracts for the purchase of Central Arizona Project water,
but have received conditional allocations of Central Arizona
Project water, and
WHEREAS, the City of Apache Junction wishes to
protect and maintain whatever rights it may have now or in
the future to municipal or industrial Central Arizona
Project water in the event either or both of the above -named
private water companies fail to enter into agreements for
the purchase of Central Arizona Project water or otherwise
meet the requirements of law for the receipt of Central
Arizona Project water, and
WHEREAS, the City of Apache Junction is desirous
of contracting for the delivery of Central Arizona Project
water under approved contract terms and conditions with the
Department of Interior and the Secretary of Interior,
THEREFORE NOW BE IT RESOLVED that the City of
Apache Junction, Arizona officially notifies the Secretary
of Interior of the Department of Interior of United States
of America of the intent of the City to contract with the
Secretary of Interior of the Department of Interior of the
United States of America for Central Arizona Project
municipal and industrial water in the event that either the
Arizona Water Company or Consolidated Water Company, both of
whom provide 100% of the City's water supply, fail to enter
into unconditional contracts for Central Arizona Project
Water or fail to meet other requirements of law for the
receipt of Central Arizona Project water, and
FURTHER RESOLVED, authorizing the City Clerk to
certify this resolution and forward the same with the Notice
of Intent to the United States Water and Power Resources
Service for their consideration.

1981 by the Mayor and City Council of the City of Apache
Junction, Arizona.
