HomeMy WebLinkAboutRES 81-11RESOLUTION NO.81-11 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,DECLARING THAT THERE IS AN ADVERSE IMPACT OCCURRING WHICH IS SERIOUSLY RESTRICTING POTENTIAL AND NEEDED DEVELOPMENT IN THE CITY OF APACHE JUNCTION DUE TO THE PASSAGE OF THE ARIZONA GROUNDWATER MANAGEMENT ACT OF 1980,AS AMENDED;AND REQUESTING THAT PRUDENT AND TIMELY ACTION NECESSARY TO ALLEVIATE THIS ADVERSE IMPACT ON THIS ENTITY BE TAKEN BY THOSE WITH AUTHORITY. WHEREAS,the Arizona State Legislature did pass the Arizona Groundwater Management Act of 1980,as amended,which is intended to facilitate sound management and conservation of groundwater i n the State of Arizona;and WHEREAS,the Act establishes Active Management Areas i n the state and the city of Apache Junction lies within the Pinal Active Management Area;and WHEREAS,the Act requires that prior to approval of the subdivision plats by the city or Arizona Department of Real Estate, the Department of Water Resources must issue a "Certificate of Assured Water Supply"signifying that the area has a 100 -year water supply available through natural means or by supplement from an outside source;and WHEREAS,the city of Apache Junction at this time has approximately a 70 -year supply of water by natural means with no approved outside supplement;and WHEREAS,the city's domestic water supply i s supplied by two private water companies;and WHEREAS,the Act treats cities with municipally -owned water utilities differentlY -from cities.with private water companies, thereby creating an inequity;and WHEREAS,cities with municipally -owned water utilities may continue to approve subdivisions merely by signing Letters of Intent to contract for Central Arizona Project water,Apache Junction must enter into Final Purchase contracts for Central Arizona Project water allocations due to the fact that its sole supply of domestic water i s from private water companies,creating an inequity;and WHEREAS,due to its location and quality of life offered, Apache Junction has been and i s one of the fastest growing cities i n the State of Arizona,growing from 2390 persons i n 1970 to 9935 persons i n 1980 with an estimated 20,000 -plus winter visitors and with another 2,000 persons residing i n the immediate vicinity i n Pinal County;and WHEREAS,the inability of Apache Junction to approve sub- divisions i s forcing persons to find other alternatives to housing, including locating in other cities in the same Active Management Area partially due to their ability to gain subdivision approval as a result of municipal operation of water utilities; NOW,THEREFORE,BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,that there i s declared an adverse im- pact occurring which i s seriously restricting potential and needed development i n the city of Apache Junction due to the passage of the Arizona Groundwater Management Act of 1980,as amended,and; BE IT FURTHER RESOLVED that the city of Apache Junction is committed to sound management and conservation of the scarce resource of water,but requests an equitable solution of allocation with regard to subdivision development within the city and to the inequitable im- pact of the legislation upon development i n cities whose domestic water supply i s provided by private water companies;and BE IT FURTHER RESOLVED that the City Clerk be and hereby i s authorized and directed to send certified copies of this Resolution to the Governor of the State,Arizona State Legislative Delegation,the Congressional Delegation,the United States Secretary of the Interior, the United States Water and Power Resources Service Central Arizona Project Division,the Pinal County Board of Supervisors,and other appropriate officials.
