HomeMy WebLinkAboutRES 82-09RESOLUTION NO.82-09 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,ARIZONA,DECLARING THE CITY COUNCIL'S OPPOSITION TO THE PASSAGE BY THE ARIZONA STATE LEGISLATURE OF HOUSE BILL 2129,MANDATORY SOLAR ACCESS. WHEREAS,there exists permissive legislation whereby a munici- pality may regulate access to incident solar energy;and WHEREAS,the proposed language is vague as to limitation and type of regulation for incident solar energy (for example,would a property owner,perhaps,have to refrain from having trees that block solar access from a neighbor);and WHEREAS,the language in the strictest sense could result in far-reaching urban form changes,including the environment;and WHEREAS,mandatory legislation would require having professional staff to enforce the mandated regulations,said staff to have certain expertise and for which many small communities simply have not budgeted; and WHEREAS,the legislation does not define the degree of incident solar energy to be regulated; NOW,THEREFORE,the City Council of the City of Apache Junction, Arizona,does hereby declare its opposition to the passage by the Arizona State Legislature of House Bill 2129. BE IT FURTHER RESOLVED that the City Clerk is hereby directed and authorized to send certified copies of this resolution to the Arizona legislative delegation from this area and to Governor Bruce Babbitt. PASSED AND ADOPTED by the Mayor and City Council of the City of Apache Junction,Arizona,this 16TH day of March 1982.
