HomeMy WebLinkAboutRES 82-11RESOLUTION NO.82-11 A RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE CITY OF APACHE JUNCTION,PINAL COUNTY,ARIZONA,OPPOSING HOUSE BILL 2383,PRESENTLY UNDER CONSIDERATION BY THE STATE OF ARIZONA 35TH LEGISLATURE,AND DECLARING AN EMERGENCY. BE IT RESOLVED by the Mayor and City Council of the City of Apache Junction,Arizona,that: WHEREAS,House Bill 2383 was introduced for legislative consider- ation on February 4,1982;and WHEREAS,House Bill 2383 will adversely affect the City's ability to insure control of television construction,operation,and maintenance;and WHEREAS,House Bill 2383 may eliminate the availability of access channels for use by Apache Junction citizens;and WHEREAS,House Bill 2383 removes all controls on rate regulation i n a defacto monopolistic situation;and WHEREAS,there appears to be a reasonable desire for the City to exert a certain amount of control over the construction,operation,and maintenance of the cable television system;and WHEREAS,the City has considered a complex television licensing process intended to provide the controls requested by the citizens of Apache Junction. WHEREAS,House 3ill 2383 will take away the City's right to provide programs that are desirable and beneficial to the citizens of Apache Junction;and WHEREAS,House Bill 2383 will effectively remove the City of Apache Junction's right to govern itself locally i n the area of cable television service;and WHEREAS,municipal governments are more knowledgeable and sensitive to the programming and installation method needs of its citizens than other governmental agencies or private concerns. NOW,THEREFORE,BE IT RESOLVED that the Mayor and City Council of the City of Apache Junction oppose House Bill 2383 and urge the members of the Arizona 35th Legislature to vote against its passage. WHEREAS,the immediate operation of the provision of the Resolution i s necessary for the preservation of the public peace,health and safety of the City of Apache Junction,an emergency i s hereby declared to exist,and this Resolution shall be i n full force and effect from and after i t passage, adoption and approval by the Mayor and Council of the City of Apache Junction, and i t i s hereby exempt from the referendum provisions of the Constitution and the laws of the State of Arizona.
